    I think Dan Ptak is going to regret suing customers that he paid weeks late. Ptak / Jevin, according to Defendant's counsel first breached the contract and committed fraud. They are also vigorously challenging jurisdiction. It looks like these Defendants may be out of this nonsense in round one.

    Fascinating to note that Jevn and Ptak's counsel, LeAnn Diamond, was a partner at Albin Roach law-firm until December 2016. Partners W. Todd Albin and John Mongogna of Albin Roach are now her opposing counsel representing the 75 defendants from Utah in this current case.

    I wish that I had the opportunity to give you and the board the real facts. We were in fact victims of fraud perpetrated by one organization. They used the publicity as a smoke screen to hid their theft. We are currently pursuing legal action against that organization and all of the parents of the organization. We are also considering defamation suits against all parties who have made public statements that are disparaging to Jevin – including those that are making claims that multiple organizations are owed money. It is unfortunate that those that break the law and damage others seem to ‘win’ in our society.
    This e-mail from November 2016 refers to Sky View. How can Ptak accuse these folks of theft when they were just doing chargebacks in order to recover their own registration fees so that their children could play? These poor folks had fought with him for weeks to get their money that he was supposed to forward the next day according to his own contract. They only invoked the lawyers, media and police when they had no other alternative. Stealing their own money! Hello, Danny the dumba$$!

    How many more customers (or should I say former customers) is this total clown going to sue??? I have dozens of e-mails describing the late and missing payments in detail from across the country and I gave all the contact info for those leagues with late and missing payments to the incredible reporter that did the story above. Dan Ptak trying to sue his customers into silence and submission will just send every last customer packing with all due haste.

    I bet they are thrilled that his SSL certificate has expired and they still can't access the site.

    The game is about to be over. Duck, duck, duck, duck.... is about to end with a resounding GOOSE. Dan Ptak and his Jevin scam will now be served as there is an order in place, and the hearing to dismiss the case will get cancelled the minute he is served by an alternate method approved by the court as stated in that order.

    I am betting on a win for the Plaintiff due to default judgment. I doubt Ptak can afford an attorney and drawn out fight. The corporation must be represented by an attorney in Texas as the law will not allow anyone (even the owner) to represent a corporation that is not licensed counsel. The fun is about to start.

    I remember with such fondness the Advantage Conferences' bank account being emptied by a garnishment by the Better Business Bureau of Dallas after winning in court against that pyramid scheme. Good times!

    Garland Soccer Lawsuit Successful David Arciniega Ousted!

    David Arciniega received 10 votes. Rachel Beltran took the president’s seat with 20 votes.

    Treasurer, Sam Perry, withdrew his name from the ballot. Jesse Flores was voted in from the floor.

    A newer member, Laura, successfully defeated Erick Quintana for the position of Publicity and Awards Director. Erick Quintana signed a No Confidence Petition against me because I supported a more qualified candidate opposing David Arciniega for president in 2013. I have filed complaints about this blatant harassment and election tampering that have yet to be heard. I expect Erick Quintana to be suspended from all soccer activities due to this. I passed out copies of the egregious petition filed against me and spoke out in support of free and fair elections going forward at the meeting.

    The positions of Facility and Equipment Director and Special Events and Training Director went unfilled as Don Starkey had announced his departure at the beginning of the season, and Terry Walser withdrew his name from the ballot at the election.

    Rosemary Martinez, who provided excellent customer service for years, has left. Gayle Brandt is also leaving.

    The settlement announcement was shared with the coaches:
    Announcement
    Heather Dobrott and the Garland Soccer Association and David Arciniega announce that all matters in controversy between them in the lawsuit filed by Dobrott against the Association and Arciniega have been compromised and settled. No payment of damages was made to Dobrott as that was not the purpose of her lawsuit. Further, Dobrott did not receive full reimbursement of her attorneys’ fees incurred as part of the lawsuit. As part of the settlement, a contribution to the Garland Soccer Association Scholarship Fund will be made in Dobrott’s name. The parties have agreed in their settlement to confer and discuss the issues raised by Dobrott in the lawsuit and to work together toward a betterment of the Garland Soccer Association and the children it serves.

    I have been in contact with USSF’s legal department and will file a national grievance against any administrators and/or NTSSA if the issues I have raised are not fully investigated, heard and handled as the by-laws dictate. I will continue to work tirelessly until there is transparency and full accountability in North Texas State Soccer.

    It is imperative that all member associations do their due diligence on all prospective candidates for the North Texas State Soccer Association board and see that David Arciniega, Larry Hall and the others who have been wreaking havoc are voted out. It is high time NTSSA follow its own by-laws and handles grievances and appeals promptly instead of sweeping them under the rug.
    That is the announcement that I have been sending out all over the world wide web today. The new leadership in Garland Soccer I expect will be archiving all the records in Jevin and changing vendors as soon as possible. I also expect the new board will thoroughly investigate and document what happened to the missing funds and why David Arciniega insisted on retaining this vendor.

Each Board member should successfully execute and solidify their understanding and execution of the bylaws and procedures highlighting opportunities for improvement to the organization and mitigate all risks of corruption, theft, prejudice and discrimination to any and all members relative to any Soccer Association.

    The parents, Coaches and players have had enough and each of those individuals were voted out this last week in the election. Now we can rebuild GSA back to the organization that it once was, when it was all about the kids. Hope to see each and every one of you at future elections to participate in eliminating youth sports corruption vs ridiculing someone who did stand up and fight for the kids.

    VIRGINIA BEACH, Va. - Virginia Beach Little League says they's missing nearly $40,000 after they hired a company to help with registration, but the league president says they never got the registration money.
    Doug Will, the president of the league, described the feeling as "it's frustrated. It's disappointed. You just can't really believe because you hear about things like this, but you don't really think it's going to be you."
    It all started earlier this year. The league hired a company called Jevin to manage online registrations for the team. About half of the parents signed up online, but Will says they've never been given the registration money they're owed. The league had used web services from Jevin before and tried to sort things out, but Will says it's now been months with no clear answers about where the money is. Instead, Will says he's been met with several excuses.
    "We're not giving up," Will said. "The money is ours and we should get the money."
    Jevin is based in Allen, Texas. The company helps leagues manage their online databases and website. Other leagues around the country have made similar allegations, including in Utah and Florida. A police spokesman for the Allen Police Department said officers tried to take out criminal charges against Jevin, but the district attorney declined to prosecute.

    In response to several News 3 questions, Jevin's president, Dan Ptak, said only, "Due to pending litigation, it would be inappropriate to comment at this time."
    Will says the league is still able to operate, but is not able to make improvements or repairs to facilities.
    More victims of Jevin. And there are rumors that yet another organization that has not come forward is out tens of thousands as well.

    The Virginia Beach Little League isn’t the first sports organization to claim that Jevin, a Texas-based sports management company, has failed to disperse funds to leagues as agreed. (Derek Mason/Southside Daily) VIRGINIA BEACH – What happened when a youth football league tried to recover missing registration funds from an online sports management company – the same company that is holding nearly $40,000 in funds belonging to Virginia Beach Little League?
    Seventy-three of the league’s parents were sued.
    On Monday, Southside Daily reported that VBLL was missing $38,000 in registration funds. The league’s president, Doug Will, claimed that Texas-based Jevin was illegally holding those funds and that attempts to claim them had gone unanswered.
    The local little league isn’t the first to make the claim against the company and its CEO, Dan Ptak.
    Jeff Young, a volunteer parent with the Sky View Youth Football League in Logan, Utah, told Southside Daily that their league had been through a similar situation with Ptak and his company. The league fought with Jevin for months over $45,000 starting in January 2016.
    “We went through the season, back and forth, and it was a nightmare,” Young said. “It was an absolute nightmare trying to get any information from Ptak.”
    Young said the financial battle still continues and excuses from Ptak ranged from not being able to access the funds to the sudden death of a pet.
    After the Utah league unsuccessfully attempted to collect registration funds, parents began filing claims with credit card companies to get their money back. After that, Young said Ptak used the league’s private information to send a letter to 73 parents demanding immediate payment for $10,000 in penalties the Texas company received from those credit card companies.
    That fall – long after the end of the season for which the registration fees were nowhere to be found – Young said Ptak hit back with a civil lawsuit in Texas courts, suing dozens of parents.
    Young and his wife Breanna, who serves as the league’s president, were among those Ptak sued.
    “He’s a bully,” Young said of Ptak. “I’ve never dealt with the likes of this person ever in any business that I’ve ever done. No one has ever seen the type of business this guy does.”
    Young said Texas lawyers hired to represent the Utah league told parents that had Jevin stuck to the agreement in the contract the penalties – and the lawsuit – would have never happened.
    “The agreement states that Jevin will deposit the money next business day for all transactions,” Young said.
    Ptak sent another letter to all Jevin users last summer which claimed the Utah league was “trying to publicly ridicule Jevin and take the company down” according to Young. Will said that Ptak also told him the Utah parents were responsible for Jevin’s funds being frozen, which prevented the company from dispersing VBLL’s funds this spring.
    “I find it kind of interesting that Ptak could get all of the money, but he just can’t pay any of the money,” Young said.
    Though the legal battle is time-consuming and frustrating, Young said what makes him most upset is that Ptak is continuing to hold funds from other leagues.
    VBLL had not yet reached out to local law enforcement or credit card companies as of Monday to recoup the funds. Will said the league has been apprehensive because they were afraid of retaliation from Jevin and Ptak.
    “All of our information, from contact info to rosters and schedules, was in the Jevin management system,” Will told Southside Daily on Monday. “We feared that if we took that avenue, Jevin might shut our season down. We didn’t want to impact the kid’s ability to play.”
    VBLL has since partnered with another online sports management system, SI Play, to manage their database and handle registration fees.
    Additional requests for comment to Jevin about VBLL went unanswered on Tuesday. Requests for comment about the Utah league were declined.

    In an email obtained by Southside Daily on Monday, Will told his league’s many parents that their registration funds were never received, but not to the fault of the parents.
    Instead, Jevin – a Texas-based company thats helps little leagues across the country manage their databases, rosters and funds – never settled up and paid Will’s league what they were owed: $38,000 – about 50 percent of the league’s registration fees, Will said.
    “About half of our players registered online,” Will said in an interview on Monday afternoon. “The parents go online, register and then the money goes from Jevin and it’s supposed to go to our account after that.”
    Hosted by Texas-based Jevin, the online platform was to collect and disperse registration fees for the Virginia Beach Little League, said league president Doug Will. (Screenshot of the online payment platform captured Monday, July 31, 2017) But that never happened, Will said. The league should have received all registration fees by the end of April. When they hadn’t, Will said he reached out to the company repeatedly, only receiving vague answers from Jevin’s owner Dan Ptak every few weeks.
    Ptak claimed that he had been hacked and his money stolen. Weeks later, Ptak told Will that his email system had been down and that’s why he was unable to communicate with Will. After another series of calls and emails, Ptak claimed his banking system was down, preventing the disbursement of any funds.
    “Before we used the online registration system, Jevin was always very helpful and responsive,” Will said. “But when the money was involved, all of sudden they didn’t return calls and emails.”
    Will said Ptak even told him that parents in other little leagues were out to shut him down and his money woes were a direct result of that feud.
    “Some of the excuses we’ve gotten have just been laughable,” Will said.
    The Tampa Bay Times reported that when parents in St. Petersburg began filing credit card claims against his company, “Ptak gave excuses for not providing the money, such as having to deal with a family emergency or traveling out of town.”
    Sgt. Jon Felty, a spokesperson for the Allen Police Department in Texas where Jevin is based, told Southside Daily that their office was aware of Ptak’s company. Felty said that the Virginia Beach Little League isn’t the first to make the same allegation against Ptak’s company.
    “We had criminal cases filed against them, but the problem with it is we can’t get them prosecuted,” Felty said. “Unfortunately, the little league teams hadn’t kept good financial records.”
    Felty said Jevin’s online platform was a con, and several other sports organizations around the country and in Texas had fallen victim to it. He said the department was disappointed that cases filed against the sports management company weren’t able to be prosecuted.
    “None of the teams seemed to have a real good grasp of who they were doing business with,” Felty said. “If it sounds too good to be true, it is.”
    Similarly to the little league’s troubles, at least two other sports organizations also tried to recover funds they never received from Ptak’s operation.
    The Tampa Bay Times reported in October 2016 that Northeast Little League was out $35,000, while the Herald Journal reported that Sky View Youth Football in Utah was missing $45,000 in June 2016.
    While Will continues his fight to recoup the nearly $40,000 from Jevin, he said his league is fortunate enough to move forward with fall registration in the next week.
    The league has already partnered with another organization to manage online registration, and thanks to funds in the league’s savings account, they were able to finish the spring season as planned. Registration fees for the fall only increased about $5 for each player.
    If there are any maintenance issues or problems that need tending this year, though, Will said the league will suffer.
    “We can’t do some of the things we wanted this year, like installing new lights on the fields,” Will said. “If something breaks or something needs repair, we won’t necessarily have the funds on hand.”
    When reached by Southside Daily on Monday morning, the Jevin support team said they would not be able to answer questions about Will’s allegations due to a sudden emergency.
    When pressed for comment before deadline, representatives again declined to answer specific questions about Will’s claims and advised against publishing a story.
    Requests for comment from Northside Little League and Sky View Youth Football league were not returned by publication.

    ***** collected money on behalf of our league and has not returned to that money to us. They do not answer phone calls or return emails.
    ***** was not supposed to collect funds from our league members, however they did anyways. It has been nearly 3 months and they have stopped returning emails and phone calls and have not deposited our funds paid to them. 11 league members paid $80 and ***** will not forward that money to us nor will they communicate with us.     Our business entered into a contractual agreement in November 2015 wherein Jevin would process credit cards and host a registration site for the purpose of my sport facility's scheduling, registration of players, and general communication with clients. Jevin has never deposited ANY funds that were from credit/debit card payments into our account. We, a small family-owned business, are owed almost $50,000. At this time, Jevin has not returned phone calls nor provided any indication they have any interest in depositing funds that our rightly ours. Dan ***** the owner, has stopped returning our calls, and has made promises regarding the timing of our funds availability that have proven to be untrue.

    VIRGINIA BEACH, Va. (WVEC) -- The Virginia Beach Little League is out $38,000 after the league president claims a Texas-based company never paid them the money they're owed.
    Doug Will, the president of the league, said they used the company to handle online registrations for the spring season but then company never sent the league the registration money.
    "I reached out to them 'Hey guys I haven't seen any money' and I wasn't getting responses. Every once in a while I would get a response and just got excuses why they couldn't pay," said Will.
    That company is Jevin, Inc. based in Allen, Texas.
    They never got back to 13News Now when contacted about the accusations.
    A search on the Better Business Bureau site shows it's not BBB accredited and two other people have complained.
    One said on the BBB website the company is a small family-owned business and Jevin owes them almost $50,000.
    "You know at first you're in denial, thinking there's something wrong on the other end," said Will.
    Out thousands of dollars, Will can't move forward with other projects painting, repairing roofs, and fixing the batting cages.
    "It takes a lot of people and a lot of money to keep this place up and running," he said.
    Up and running the little league will stay, despite what gets in the way.
    "We've got to keep moving forward. We're not going to let it stop us. It won't stop us," he said.
    Will said they've since switched to a new company to help with the online registrations.
    He said they've also talked to different attorneys and plan to take legal action soon.

    Thank you for reaching out to me. I would be happy to answer your question.

    Our experience with Jevin has been nothing but great. There are a few items in the software that we would like to change, but I don't know of any software that doesn't have items that don't work exactly like you would want them too as all organizations are so vastly different in how they form teams and manage their rosters.

    However, any time we have had questions they have always been right there to answer them. I have had two or more online teleconferences with them so they could walk me through things and help me figure out how to do what I needed to do.

    As for our money, it has always been deposited exactly when we would expect it. There has only been one deposit, that I know of that was ever not deposited on time. The deposit was missed in February of 2014, before I became treasurer, and I didn't discover it until November of 2014 when I got the books from the old treasurer and I was looking back to try to balance out the checkbooks.

    I contacted support and Dan Ptak and within a couple of weeks we had our money. They didn't have to do that. They could have easily told us the money left their bank and we didn't catch that it didn't hit our bank account and we were out of luck. But they didn't. They worked with me and they got us our money even though I was 9 months late in noticing the missing deposit. (Most banks only give you 30 - 60 days).

    We have, and will continue to, recommend Jevin to all the leagues in our area as a great software provider. What it sounds like to me is that Mr. Arciniega has embezzled a lot of money from GSA and instead of taking the fall for it he is trying to blame Jevin.

    If you have the bank statements and administrator access to the Jevin account I can easily show you how to prove which happened so you will know for sure. There is a report in Jevin that shows all money collected and all the funds say Jevin when they are deposited into the bank account.

I do not have the time, energy, or want to deal with some whacky lady half a nation away, and if I EVER come across your name again in association with my league or any member of my league, every bit of time and energy I spend on it will be to make you miserable thru every legal means possible equal to and greater than what you seek out with Jevin.     The complaints that earned Jevin an F rating with the BBB I don't believe were included in any newspaper articles or my blog totals so far. That puts the number of leagues with late or missing payments between around 21-23 and the total amount of late or missing funds at well over half a million dollars.

    "Sgt. Jon Felty, a spokesperson for the Allen Police Department in Texas where Jevin is based, told Southside Daily that their office was aware of Ptak’s company. Felty said that the Virginia Beach Little League isn’t the first to make the same allegation against Ptak’s company.

    “We had criminal cases filed against them, but the problem with it is we can’t get them prosecuted,” Felty said. “Unfortunately, the little league teams hadn’t kept good financial records.”

    The City of Pleasant Hill has thanked me yet again. If the city told Byers what she has claimed they did, then why are they thanking me and sending her (the little league Treasurer) and her bully of a husband, Jim Byers (the little league president) what I was posting? Garland Soccer sent David Arciniega packing. It looks like the little league has some housecleaning to do as well.

    Little league claims it’s owed thousands

    VIRGINIA BEACH, Va. (WAVY) — Out in Ocean Lakes Park, the cry isn’t “play ball,” but “pay up.”
    The Virginia Beach Little League claims it is owed $38,000 from an online sports service that registers little league children online, but apparently failed to hand over the money.
    When 10 On Your Side went out to Ocean Lakes Park, we found a little league president who wants his money, an email admitting something is owed and a little league family who just wants to play the game.
    The Virginia Beach Little League is the largest in the city and is a snapshot of America. When you go to the seven fields — even when games aren’t going on — you can usually find a mom or dad hitting balls to their children.

    Then trouble visited the fields. “Probably in March,” says Little League President Doug Will.
    March was when the game went foul, and that is when league President Doug Will realized $40,000 was missing.
    “When we started doing a little research online, we realized this wasn’t just us, it was a lot of people had the same thing happening,” says Will.
    Online news articles note similar happenings in St. Petersburg, Florida, Smithfield, Utah — and now here. Will has used Texas-based Jevin for six years to manage the league’s database for over 700 children.
    “This is vitally important for us. We have all the kids in our league. We have their information, birth dates, addresses, their parents.”
    However, for the first time this spring, Will also used Jevin for online registration, which 350 parents took advantage of. Will says he knew in March Jevin had failed to turnover $40,000 in registration fees from parents to the league.
    Will kept this development secret until he sent out an email at the end of July.
    “I am asked that question a lot. Why wait? Well, we didn’t want our spring season impacted. There was a fear that they would shut us down if we complained to authorities or to them,” Will told WAVY’s Andy Fox as he sat in one of the dugouts.
    Will feared complaining would end with Jevin shutting down the league’s website — making a bad situation, worse.
    Will says, “We got in touch with Dan, and asked, ‘Hey Dan, why haven’t we gotten any money? Where’s the money at?”
    On April 5, Will emailed Jevin owner Dan Ptak. In that email, Will wrote to Ptak, “I think you owe us a response… Let us know when you will be able to pay.”
    What usually followed, Will says were excuses.
    “He would say his email is down. The bank system is down, or he is having a family emergency.”
    Later that afternoon on April 5, Ptak admitted he owed Will money, responding by email: “Our plan is to continue with regular payments… until the balance is $0.”
    10 On Your Side asked Will, “Did you ask him, ‘Dan, why are you doing this?'” Will answered: “No probably not, never did.”
    Andy Fox then asked, “Did you call police?” Will responded: “Nope, did not.”
    Will says Ptak did pay $2,000, but still owes $38,000. 10 On Your Side wanted to know, where’s the rest of the money? So we emailed Ptak. His only response: “Due to pending litigation, it would be inappropriate to comment at this time.”
    So what’s the trickle down of not having $38,000? That is half the price of putting lights on a softball field that are needed, and they can’t fix a broken down batting cage, or fix dugout roofs. The league is definitely functioning as they prepare for fall ball. They are operating. You get the feeling the league is very well grounded, they can respond from this setback — but it is still $38,000.
    All of this brings us to the Adamek family, who plays in the league. Dad David was hitting balls to daughter Abigail and son Chase, who said, “Us kids have so much fun playing baseball and softball. It’s just bad we lost that much money.”
    As for Doug Will, “We are fortunate we are still here. We are still playing. The sun is still up. We are still moving forward, playing ball.”

    I checked LinkedIn and Jevin went down from 2 employees to just Dan Ptak. Even the Russian guy bailed. I guess Ptak didn't buy him enough vodka.
