    Of 151 groups that were using Jevin (that I documented in exhaustive Google domain searches) in 2016 only 47 still show a Jevin link on their sites as of today. Some are registering with Jevin for the last time as they couldn't switch providers between seasons and others are in the process of transferring their data to a new provider as they have not started spring / summer registration yet. Those who have had to transfer their data said it was a complete nightmare as the crappy Jevin software left them stuck with manually moving all of their data to their new providers. Jevin is simply collapsing after 18 groups had late or missing payments in excess of $400,000.00 in 2016. Many of the abandoned Jevin sites remain up online as I suspect Dan Ptak, the owner, is desperately trying to hide the mass exodus.

    One of the groups still using Jevin had this disturbing message up. Since Dan Ptak admitted to the media that all Jevin's accounts were frozen several months ago as there have been tens of thousands in chargebacks from groups he didn't pay, this is no surprise. Parents should be careful and pay the sports charity directly with a personal check or if they must pay online be sure to use their credit card so that a chargeback can be initiated if Jevin doesn't pay (which has been happening with alarming frequency as the newspaper articles confirm.)

    Of the 151 or so customers in 2016, 12% had late or completely missing payments totaling over 400,000.00. Those customers is some cases had to do tens of thousands of dollars in charge backs and file police reports. Of that 151 customers 70% have already bailed and many more are in the process of doing so. No new customers have signed up for months it apears from the exhaustive Google searches I have conducted. Jevin is imploding!

    Jevin's customer base is rapidly disappearing. Of 152 or so groups using Jevin in 2016 only 37 remain. One group (# 153 on my list) appears to be a new customer that obviously didn't do their due diligence before signing up. Some of those are very tiny towns in Iowa that now have joined together as 1 league that play against a few other small leagues near Des Moines. Jevin has totally imploded. So, we calculate that approximately 75% of the customers have bailed this Titanic.

    Dan Ptak sued 75 or so parents from the SkyView Youth Football league because they did chargebacks and he wants the fees reimbursed. He paid weeks late when the contract actually stipulates:



    Jevin broke the contract by not paying the next business day as promised. That is why numerous groups did chargebacks and hilariously, Jevin's funds are still frozen. What kind of sick loser sues the parents of little kids playing in a youth sports charity???

    Dan Ptak e-mailed about the weeks late payments he made to this group. Clearly, as the payments were not made according to the agreement he should have sent notifications by registered mail. I predict that Jevin will be creamed in court! Not to mention as in 2013 this clown Ptak couldn't pay Garland Soccer the measly $8,000.00 he owed us, so what are the chances he can fund the tens of thousands he will need to take this frivolous harassment suit forward?

    So Jevin ( Dan Ptak ) starts getting payments from the parents on April 26 and despite the contract specifying that he will "initiate an ACH transfer ... the next business day," They do not see a dime until June 6th when they got a measly 20% or so of what they were owed. Ptak sends the rest of the funds owed on June 27th, an unbelievable 2 months later. He doesn't even give them proper notification according to the contract. Ptak should have been contacting everyone by registered mail.

    These parents paid this youth football league ( charity ) so that their kids could play football in the fall. They need those funds in order to have a season. What kind of business that has been operating for 16 years is this dishonest and totally inept? These leagues would have checked out Ptak and found out that Jevin was operated out of his home and that likely the only way to get their funds was to do chargebacks as several other leagues were already doing. Who would waste their money ( tens or hundreds of thousands of dollars ) to sue what appears to be an assetless and failing business that they could never recover anything from?

    19 leagues were paid late or not at all totaling more than $400,000.00 in late and missing payments in just 2016 alone. These parents and their league had gone to the police and the media and hired attorneys in order to get the money Jevin owed them. Now, that low life creep is going to sue them after already victimizing them unspeakably and costing them thousands???

    Can I pass on charge-back fees to my customers?

    However, as Brennan points out, passing along charge-back fees could seem unethical, so I would think hard about whether you want to attempt this. Competition among merchants is fierce, and customers in the U.S. expect generous refund policies. If you inadvertently shipped broken merchandise and a credit was warranted, how would the customer feel to see you pass along a charge-back fee on his next month's statement? Maybe he would dispute that charge, too, resulting in another charge-back for you.
    Really sad that I must point out the obvious, but no one in their right mind will ever do business with Jevin again. Dan Ptak is such a low life creep that he pays weeks late and then sues his desperate customers that were left with no choice but to do a chargeback to get their money for their little kids sports charity.

    What Is the Fair Credit Billing Act?

    How will Jevin fair in court when it is clearly about him not paying the next business day as agreed, and the parents getting their registration fees back with chargebacks so that they can pay the leagues for their child's registrations weeks after the money was needed? As he clearly violated the terms of the contract by not sending the registration monies to the league on the next business day, does he have any grounds to be reimbursed for the chargebacks? Can he slip that into his contracts with these vulnerable charities?

    I wonder if his counsel bothered to check him out before filing? As all the 19 leagues that were stiffed or paid late have been in touch with me and through me each other, Dan Ptak has legions of angry customers who are supporting one another. I hope his victims are able to turn this around on him and teach him a lesson he will never forget. I will attend hearings and the trial and do everything possible to support these charities.

    Dan Ptak and his lawyer are completely delusional judging from his harassment suit. These parents that Ptak sued paid in full and expected that Ptak would forward funds to their football league on the next business day as promised. The parents only did chargebacks weeks later after the police and media were involved and it was obvious that Ptak was not going to pay the league the money it was owed.

    The parents and the league itself did not commit fraud, or set out to hurt Ptak in any way. The parents would have simply logged into the Jevin site and registered by filling in the blanks and giving their credit card information to this shyster. They could not have possibly made any representations to Ptak that were false in relation to their intent to pay. What a load of pure crap!

    They expected him to forward their money to the league after removing his fees as the contract stipulated. How could there have been any conspiracy to harm Jevin and Ptak? These parents had paid and simply wanted their kids to get to play football. When Jevin / Dan Ptak breached the contract as had been happening all across the country as numerous articles document, the parents did what they had to to recover the funds Jevin had refused to pay according to the contract. Jevin's breach of the contract is to blame for this whole sordid saga and I hope he gets counter-sued and hung out to dry after harming all these charities! The defense is so simple. Jevin breached the contract by failing to pay on time and weeks later the parents exercised their rights under the Fair Credit Billing Act.

    Ptak was adamant that his company distributed Sky View's money on time and said it has blown the situation out of proportion.
    That is contradicted in the suit this clown filed. The contract he attached promises payments will be made the next business day. The dates he lists in the filing are certainly nowhere near the next day. Dan Ptak and Jevin paid weeks late only after a media storm, police involvement and the league consulting with counsel.

    The owner of Jevin, Daniel Ptak, told ABC Action News reporter Michael Paluska that his software management company were victims of a fraud after Ptak claimed someone tried to steal the registration fees collected.

    “The bank froze our accounts,” Ptak said.

    Ptak would not comment on the group that he says tried to defraud his company. So, there was no way for ABC Action News to search for a police report verifying his story.
    There is no police report, because Ptak is actually twisting the issues with Sky View Youth Football. He had paid them late and they exercised their right under the Fair Credit Billing Act to initiate chargebacks because "he had charged for goods and services that weren't delivered as agreed." Ptak not forwarding the registration money to the football league the next business day, but actually weeks late is the reason for the chargebacks. They initiated those chargebacks after going to the police, media and licensed attorneys and they were initiated well before he paid them weeks later.

    Dan Ptak is lying when he tries to paint that as fraud and claims the money was stolen. Of course, he couldn't file a police report, so he ducked the reporter's question. He doesn't mention that he paid Southeast Louisiana nothing of the 31 grand he owed them and they had been doing boatloads of chargebacks during that time as well. SELASA just had not gone to the media yet. They still have yet to see a dime. They did participate in news stories published after this one and are speaking out about this outrage!

    The law firm is not going to be too happy with Leann Diamond when this embarrassing fiasco comes to light in the press and they loose thousands carrying this case that is going to go nowhere. Suing volunteers running a charity for kids and the innocent parents is so despicable!

    That was exactly what came to my mind when I saw that he had listed you in his filing. The last thing someone doing what he is doing wants is for ANYONE, let alone lots of ANYONES, to get a look at his communications, books, and financials. His records and bank records will show him to be a liar and a fraud. And while you are at it you get to look at everything he has done with his transfer agents, which add more proof of his mountain of lies. Really NOT a smart move on his part. Then you can also look in to his inappropriate relationship with your league president and see what they had going. Just really not a smart move on his part.

    I have a few, well a lot really, thoughts on his lawyer. If the lawyer is at all competent, he has to know that Ptak is going to get his ass handed to him, and possibly even go to jail. I don't know how they do it in TX, but around here that sort of thing gets automatically referred to the prosecutor at the end of the trial. They take a VERY dim view of that sort of fraud here. I'm also wondering how he thinks he is going to get paid since I am pretty sure Ptak is pretty well tapped out. He doesn't strike me as the smart type, as witness going to court, so I doubt he'd have stashed any of it away and I'm betting he's mortgaged to the hilt and beyond.

    A very clever legal strategy, providing proof that you lying out of both sides of your mouth in your court filing to sue someone else. Really clever that.

    Something else he can't do is file a police report on the "theft" as then the police would look in to it and find out what really happened. Or worse, get the FBI involved if he claims his bank was involved. This guy is a whole lotta stupid.

    This is definitely a project.

My count using what Google searches pulls up shows no more than 40 groups still using Jevin though Datanyze lists 55 groups. 9/10,000 Ranked 38 out of 54 by Datanyze in their Recreation Management Software Market Share Table. Datanyze does not include Sports illustrated Play in that group either and they are rapidly capturing this market. Jevin obviously is not growing as Brian Stracke was claiming in the fall of 2016.

    Seifert, manager of the Centennial Youth Baseball-Softball Association in suburban Denver, said he first noticed in March that his youth baseball program hadn't received nearly $80,000 he said Jevin owed it.

    Registration for its spring season started in December, and he said the league didn't receive any payments until mid May, when the company gave it half of what it was owed. The other half finally arrived in late June, he said.

    Young and Northeast league officials said they fear that Jevin is improperly distributing to one league the money collected from families in other leagues.
    The other leagues that spoke to the paper, Northeast Little League and the Southeastern Adult Soccer Association, were out $35,000.00 and $31,000.00 respectively and Jevin never paid them a dime. They only got what parents and adult players were able to recover through chargebacks. Jevin has had late payments reported for years. In 2016 I counted 19 leagues that had late or still missing payments. Centennial, a league that has thankfully spoken out, collected $80,000.00 in registration fees in December 2015 and January 2106. They should have had payments sent out to them by Jevin the next business day or 48 hours (whatever the specifics were in their contract.) They didn't see a dime until Jevin paid half of what was owed in May 2016. They contacted me in June and later on that month they got the remainder of what they were owed. No way I buy that they were paid with their own funds.

    Business Loan Agreements ("the agreements") with Celtic Bank which subsequently
    assigned the agreements to Kabbage, Inc. which in turn assigned the agreements to

    Defendants are in default under the terms of the agreements in that certain
    payments have not been made as required. As of the date of the filing of this petition,
    after allowing all credits, there remains due and unpaid under the terms of the agreements
    the total principal amount of $90,432.00.
