    I hope you guys are delaying the start of the season. This is pretty ridiculous that we are less than five days away and we don't even know when we are playing. We had our first practice tonight because you locked the rosters while doing the scheduling. Viscous circle. We have one more practice before Saturday, and I've got four new boys on my team.

    This is my third season coaching, and I know this is your first year in this position, but it is getting less and less organized every season. I hope this isn't a reflection of how things are trending.

    This came to my fellow director, Mrs. Sex Offender Attachment 24503. This is totally on the money and typical of what I always hear. GSA is a disorganized mess. All our neighboring associations have clear cut-off dates for registration, are very organized and ready to start on time long before we open our seasons. We are losing coaches and players in droves because of this.

    That team and coach are long gone. Is North Texas going to step in before GSA implodes under the current leadership?

    All A & D hearings have been conducted in violation of GSA and NTSSA bylaws and rules since David Arciniega took office as president. All of these hearings should be considered null and void. All GSA A & D hearings and the process should be investigated and reviewed by NTSSA. Coaches should refuse to serve on the panels until David Arciniega is removed and the A & D process brought into compliance with the bylaws and rules. The lynchings need to cease!

    The A & D process in Garland Soccer is completely broken. David Arciniega has used the A & D process as weapon to harass and intimidate. David Arciniega, according to Kim Verity (the former Vice President), made her file charges against me and a fellow director because we supposedly instructed in the placement of a player and coach. The son ended up on his coaching father's own team as he was the correct age. Who would agree to coach on an opposing team against their own child and conduct practices for one team while having to drive their child to another team practice in the same age group??? David Arciniega was desperately looking for a way to run off directors who asked too many questions and demanded honesty and transparency.

    PURPOSE AND RESPONSIBILITY:
    The Appeals and Disciplinary Committee is responsible for the investigating, hearing and
    disposing of, in an equitable manner, all matters that are contrary to the By-Laws and Rules of
    the Association. All players, coaches, assistant coaches, team managers, parents, spectators,
    administrators, and others who are registered in GSAI and/or participate in soccer activities
    within the jurisdiction of Garland Soccer Association, Incorporated shall abide by the By-Laws
    and Rules of Garland Soccer Association, Inc., and will be subject to the decisions made by the
    GSAI A&D Committee.
    A.
    Committee Procedure:
    1.
    Notice of Alleged Infraction of the By-
    Laws or the Rules: Upon receipt of written
    notification, the A&D Committee shall conduct a confidential investigation by
    questioning any person with first -hand knowledge of the facts. The investigation must
    include an interview with the accused unless it can be determined no further action,
    including the preferring of the charge(s) is necessary or warranted. For the protection of
    parties who may be innocent, the investigation will avoid revealing details as much as
    possible.
    2.
    Preparation of the Charge(s): If necessary, the Committee will prepare the charge(s) that
    will be brought against the accused and the specifications(s) that will be addressed by the
    Committee.....

    The Penalty
    a.
    The determination of the penalty shall be made in the form of a motion by a
    Committee member. This motion is debatable and amendable by other Committee
    members. A Vote on this motion for penalty shall be taken by the Committee
    members and the results of the vote shall be recorded by the Chairman.....

    2.
    A coach, player, spectator, Board Member, or any other member of the Association that is
    found guilty of violating the rules and/or By-Laws of NTSSA or GSAI shall be penalized
    the prescribed penalty, if stated, and/or any additional penalty imposed by the A&D Committee...

    STANDING COMMITTEES
    2.1
    Appeals and Disciplinary Committee:
    It shall be composed of the Vice President as Chairman and four (4) Association Coaches in good standing.

    A member of the Referee Committee,designated by the Referee Director, may be in attendance as a nonvoting representative and advisor. The Chairman shall call all meetings; specifying thetime and nature; notify all participants; and shall vote on matters only to establish a majority vote. The chairman shall notify the Association President and Director(s) of all Committee rulings immediately and

    Selecting A Committee
    It is the responsibility of the Member Association to maintain and provide to NTSSA the name of the A&D Chairman and also to provide a list of the Committee Members with their addresses and phone numbers.

    There has not been a standing A & D Committee since rogue president David Arciniega took over. Without a committee that is listed properly with NTSSA then all of the hearings in Garland have been illegal. Coaches have informed me that the hearings have serious issues and are not fair. Many coaches are rightly refusing to serve on A & D panels due to this.

    NTSSA and US Youth Soccer need to take jurisdiction and clean up this association!

    North Texas State Soccer Association (501 c 3 over Garland Soccer Association) says:
    2.2.6 Jurisdiction
    This Association shall have jurisdiction over all Member Associations’ administrators, referees,
    coaches, assistant coaches, managers registered players and teams affiliated with it. Each Member
    Association shall retain its own autonomy, but will adhere to its Bylaws and Rules and Regulations
    and will comply with the authority of the Association. If the Association is presented sufficient
    evidence that a Member Association is not adhering to its Bylaws and Rules and Regulations, the
    Association may form a committee to investigate the allegations and make recommendations to the
    Executive Committee to correct the infraction(s). If gross misuse of funds, misapplication of
    Bylaws, or misapplication of rules and regulations is discovered, the Member Association shall be
    declared not in good standing and given sixty (60) days to correct the situation, or the Association
    may take more immediate action if deemed necessary by the Executive Committee.

    seems to be typical with administrators and governments these days. Get some jerk into an office with no attempt to follow the rules governing that office. The bad part is, unless someone can step in put a stop to it, nothing changes.
    It seems like in this "industry" common sense is not all that common!

    1 Judging from the charges David Arciniega filed and Kim Verity prosecuted against me and Rachel Beltran because a child was placed on his own father's team, it seems apparent that GSA's A&D process needs some attention. Proper protocol and procedure were clearly not followed in our case.

    Suspended coach M was caught with an illegal player around November 10, 2012. The hearing was not held until over 3 months later on February 21. That was a few days before the start of the next season. That team was not given enough time to find a new coach and get organized. Hearings need to be scheduled in a timely manner.

    In Mr. M's most recent hearing for violating his suspension if only 5 actual panel members were left after he excused Mr. Arciniega and 2 directors stepped back, that hearing was held with far fewer than a quorum. With 15 board members 50% would be 7.5, so at least 8 board members must be on an A&D panel to constitute a quorum the way I am reading the by-laws. Did that hearing go forward without a quorum that could conduct business as prescribed in the by-laws?
    2 Chris Sobieski has been a fixture for years, but I believe it is time to critically evaluate whether we should be utilizing him in the future. I was told by a coach who did use him frequently that on most Friday nights the same 3 teams and their 2 coaches used him basically for their practices. Few other teams came up on a Friday night. Sunday night was apparently typically running with between 4-15 field players at those sessions. As we have no written documentation of any kind that I am aware of, we can't be sure what the exact numbers are.

    Mr. Sobieski is not taking any U6 or younger teams on Friday nights, when these new coaches that may have no playing experience are perhaps the ones most in need of help. These new coaches need concrete advice on safe and beneficial activities for use with preschoolers.

    I believe GSA's money would be better spent on G and F licenses and a few group clinics. That could be much more cost effective and more beneficial to our coaches.
    3 The "missing payments" through Jevin are very troubling. I don't think we should be using them until we have thoroughly investigated this and have concrete answers as to where that $8,000.00 went. As an organization akin to a charity we have a responsibility to be extremely judicious in the use of our limited funds. What documentation from Mr. Ptak and from Coduro do we have?

    Why is it a supposedly successful software provider with lots of clients doesn't have the liquidity to pay the 8 grand? Why is it that Jevin can't qualify for a loan? And, the obvious question, if the payment processor was slow or at this late date has perhaps absconded with the money, what action have Jevin and GSA taken in that regard? This is a very serious matter and we should not be doing business with Jevin until we have satisfactory answers.

    I did a little research online and Jevin is so small they have no listing on the BBB website. There are literally no comments about the system on discussion forums or ratings sites which is very unusual. The business appears to be a one man operation according to corporate filings with the state of Texas and the assumed name doc on Collin County's site. It is run out of Ptak's home after 12 years. GotSoccer is also about 12 years old. GotSoccer serves NTSSA and 290 of the organizations such as ours under their umbrella.

    GotSoccer did give me figures that I think merit further due diligence and discussion. Most importantly there is no contract tying us to them if we should ever wish to change providers. They charge $2.00 per player for a full soccer year. It is $10.00 per team for tournament registration. The money does not go through them, but rather the payment processor of our choice. Got Soccer sends an invoice for the money due for registration fees. The payment processor's fee will be separate and the going rates are around 2.5 - 3%. We could realize significant savings with GotSoccer and as all our data goes to NTSSA and neighboring associations that already use it that is certainly a plus.

    I will put together some rough figures for the meeting. And, I hope that GSA's AGM attendees will get more information this weekend that will help us make an informed decision.
    4 The Major League position was long ago split into 2 positions.

    "A motion was made to have a League Director for U14 thru U19 Girls in
    addition to the Major League Director who also serves as the U14 thru U19
    Boys League Director. The motion was seconded. Discussion was held. The
    motion passed (11 in favor, 1 against and 0 abstained)."
    5 I would like to exchange coaches 1 page signed coaching agreement with GSA for the ball ticket.

    6 We still need to make positive changes in educating our coaches and parents regarding protecting our kids from sexual predators. Coaches need handouts that stress never leaving a child alone and always ensuring that no child is ever left alone with an adult that is not their parent. Our website and handout materials need to cover this in detail.

    In order to facilitate making these positive changes I believe a few extra small group board meetings are definitely in order.
    For future months:
    Plans
    1 Continue to work hard to educate myself and my coaches as best possible and volunteer to help with Saturday registrations and wherever else needed.
    David Arciniega and his rubber stamping board completely ignored my plea to partner with the Positive Coaching Alliance. I linked their materials and did everything possible to make positive changes to keep our kids safe and retain coaches. Arciniega totally blew me off, but US Youth Soccer saw the light and partnered with the exact program I had recommended!

    Note I once again pointed out that the A & D process was broken. As usual nothing was done to address the glaring problems.

    I got attacked by Arciniega at that night's meeting for daring to look at alternative software providers in order to keep the money belonging to the families of Garland safe. Despite all the late payments and missing money GSA is still using Jevin.

    I also noted that GSA uses Chris Sobieski as the association coach ($7,000.00 per year / $1,000.00 per month for 5 hours a week) when we keep no records of attendance and he was not taking U6 and younger team coaches that needed help. For legal protection and insurance purposes we should have accurate sign-in sheets for all of that.

    David Arciniega has blocked motion after motion and the shrinking numbers and disgruntled coaches leaving in droves is proof!

    North Texas Soccer's president Billy Babcock and the A & D Chairman Carlos Quinones invted David Arciniega to sit on a committee for NTSSA. That should be an honor and privilege reserved for folks who are operating their own associations in a ethical and transparent manner. Arciniega had already filed phone charges against me and a fellow director and I had filed a detailed grievance. The board had fought over open meetings and NTSSA was asked to step in. There was conflict over parents being allowed to have their own children on their teams and Arciniega had called that bogus No Confidence vote on me. It was glaringly apparent that Garland Soccer was in crisis due entirely to Arciniega's leadership.

    The member associations need to closely examine how NTSSA is being run. Club Soccer is coming in........

    David Arciniega was the Vice President (the keeper of the rules) for several years and then president for the last 7 years. Look at the bylaws and then read his retarded e-mail.

    GSA Bylaws state:
    2.3
    Any member of the Board of Directors may be removed from office by a vote of no confidence
    in his ability to remain in office and perform the duties thereof.
    2.4
    Any three (3) Team Representatives may petition for a vote of no confidence provided that the
    petition shall be in writing and must be submitted to the Board of Directors. The Board of
    Directors shall review the petition and submit a copy thereof to all members within fourteen

    6) The GSA Board member who is named on the petition for a vote of 'no confidence' will be given the same amount of time (10 minutes maximum) to present his/her defense. Character witnesses for the defense will be limited to three and are allowed to speak within this 10 minute time period.
    7) I will open the floor to questions by the members regarding the items on the petition. Questions will be addressed to the defendant or the people who submitted the petition. A maximum of 20 minutes will be allocated for this portion of the meeting.
    8) My only role during this meeting will be to keep the decorum.
    9) The Elections Committee will be responsible for counting the votes.
    10) During the vote count, a member from each side may be present to witness the vote count but must remain silent.
    11) If the vote of 'no confidence' passes, the GSA Board member will be asked to step down immediately. If it fails, then the meeting will adjourn and we will move forward as an association.

    Corduro's president and CEO spoke with me. They always paid promptly. Jevin's software made processing the payments difficult and they parted ways. Again, this is months later and no litigation was ever filed much less pending or ongoing as that liar David Arciniega states. Arciniega never produced a shred of documentation concerning this despite state law supporting board members rights and duty to be fully informed and make decisions based on the facts as all board members are responsible for the finances of the charity corporation. Jevin had a history of late payments before this whopper of a "missing payment." Arciniega should have been removed immediately because of this very critical money issue!

    I raised hell with Arciniega and North Texas for his failure to follow proper protocols and procedures on this phony No Confidence vote set up by Arciniega for nothing more than harassment and intimidation. Arciniega dropped the vote for that meeting, but as I already published he and his goon squad including Kim Verity continued to threaten me. Arciniega actually didn't dare send out that lie-filled and improper petition. He is obviously so dense he thought he could order me to resign and I would acquiesce to his demand. Ummmmmm...... He should have Googled me and read about my legal adventures and of course checked out my posts here. What a putz!

    So, if I go to NTSSA for help I get a No Confidence Vote slapped on me.     1 Served on a North Texas President's Committee panel to rule on a case involving the President of a local association.
    6 Spent about 6 hours on Sunday February 24th reviewing history from our on-line system to address allegations being made by one particular coach to NTSSA about GSA's team formation practices. Determined that the allegations made by this coach had no merit. NTSSA agreed and complimented me on the research performed and the data presented.

    NTSSA has removed other errant presidents. Arciniega bragged to the board about removing that association president. A little prophetic.

    This report where Arciniega brags about GSA's team formation practices was requested by me and my fellow director who were brought up on phony charges for "instructing in the placement of a new coach, along with his son" as it directly pertained to the charges. Kim Verity and the office people flat out refused to let us see a copy. They whined that Arciniega had to approve it which he never did. Why are reports to NTSSA kept secret from the board, our member coaches and the public? What is the big secret in this charity? Why is this kind of secrecy and deception tolerated by NTSSA and US Youth Soccer?

    Brandt's removal as the GSA registrar and her assignment to another GSA position.
    Individuals that ran against Kim Verity for Vice President in 2010 and 2012 told me that the elections were rigged. Referees came in with proxies and had been instructed to vote for Verity by the referee assignor Gayle Brandt in order to "help out" and get Verity in in 2010 and keep her in in 2012.

    Only a head coach of a team or someone they personally assign their proxy to can vote in a GSA election. The proxies to the refs were given out by the referee assignor, Gayle Brandt and her husband. Gayle Brandt has no horse in the director race and is not a head coach that has the ability to hand out a proxy, but the man who pays her and can fire her, president David Arciniega, well......

    I filed a formal complaint with the current Vice President. Even though we have a very reliable witness and the meeting records would show everyone who came in with a proxy so further investigation could be done, I never got a response. NTSSA promises a prompt response. Once again, the investigation went nowhere as the Vice President is not standing up to dictator Arciniega. There has been so much harassment and retaliation allowed to go on everyone is afraid. Who would want to face phony charges and a phony No Confidence vote as I did?

    In many meetings when a vote was taken GSA was barely able to get a quorum of 10% of the voting members (well over 200 coaches.) The 14 directors would outnumber the member coaches that would come to the meeting. Of course, why bother to show up and vote when the election is rigged and already decided by David Arciniega's goon squad.

    This is why NTSSA must take jurisdiction and US Youth Soccer must permanently ban Arciniega from all soccer activities.

    Arciniega might consider reading said doc himself. Sheesh!

    Arciniega attacking board members with phony charges, baseless No Confidence votes and demeaning them to the entire board clearly violates this code. Suggestions by me and other board members were not welcomed and evaluated, but immediately tabled and swept under the rug. Garland Soccer is stagnating and the numbers are dropping significantly as disgruntled coaches and parents leave due to this unwelcoming environment.

    Arciniega lying to our members coaches and the board about the association's money is such an egregious ethics violation. Arciniega insisting we keep a board member that is married to a registered level 2 sex offender that has been handling records and in places with our children he should not be is another huge ethics violation. Not to mention when I reported Angela Bowen-Hearn to the Vice President for her ridiculous 38% meeting attendance, the Vice President forwarded my complaint to David Arciniega. The VP should have never forwarded my complaint to our unethical, rogue president. Arciniega forwarded that matter to Bowen-Hearn against the whistleblower policy and she went bananas in public. Her excessive absences should have gotten removed from the board, but once again Arciniega fought valiantly to keep her. Ms. Bowen-Hearn proceeded to verbally assault me in front of numerous coaches and parents at the Garland Fall Cup while David Arciniega snickered.

    The question is why our own Vice President who is aware of these violations and personally witnessed Bowen-Hearn verbally assaulting me doesn't take the president Daivd Arciniega up on formal charges. Why is North Texas not stepping in and disciplining this dishonest, rogue president???

    The Code of Ethics is not being enforced nor is the NTSSA mandated Committee in place to do so thanks to Arciniega.

    Age Group Directors,

    The GSA office is receiving numerous calls from new coaches and some are even showing up in person with questions on what to do or how to get started. If you have not done so already, please make sure to touch base with all your new coaches and help guide them on getting started by contacting all their players. I would also recommend that you hold an informal meeting at the fields to help answer questions and show them where their games will be played as well as where nets and flags are stored.

    For those coaches who still do not show up on their rosters, please do not send them to the GSA office in hopes of expediting the process. The GSA office is working hard to get everyone set up in order to start the season. Lets help the GSA office by doing our part to assist our new coaches.

    One last item, the GSA office is also receiving phone calls from parents who have yet to hear from a coach. Please make sure to send a message out to all your coaches, new or returning, asking them to contact all their new players.

    This is 8 days before the season was to start. Totally disorganized and chaotic as always thanks to David Arciniega. I came in board meeting after board meeting with the season dates for our neighboring associations and got shot down when I tried to get GSA in line with them. Most neighboring associations had started playing on September 6th. Plano and Wylie closed registration at the end of July and had final rosters out to coaches at meetings a month before the season started. At GSA we had had our meetings, but were scrambling to find coaches and registration remains open weeks after the season starts so this is the result. Coaches have missed meetings and have no idea what they are doing. As we are scrambling to find coaches and it takes time for the office to do several hundred background checks, the directors can't turn in schedule requests and brackets in on time and the schedules always come out late and many seasons start late (even though we are scheduled to start long after our neighboring associations do.)

    Arciniega seems to fantasize that he is picking up the leftover players from all the surrounding associations that close registration weeks before they start their seasons and will increase GSA's numbers that way. But, picking up those players means our coaches have players dropped on them until the 5th game of the season. They must deal with new players that show up for games and order uniforms numerous times. It is such a miserable experience that we lose many coaches and players that will never return. GSA's numbers are dropping and a mass exodus is on the horizon. There is no reason that GSA should be on a totally different timeline than our neighboring associations. That is also part of the reason many associations that used to play interleague with us will no longer play with us. Numerous directors, coaches and parents have complained, but Arciniega is not listening.

    GSA is a disorganized mess with several directors that are doing nothing or close to nothing and some that are new, inexperienced and since the reduction in directors have way too many teams to help. GSA is imploding.

Garland Soccer is seeing a precipitous drop because of coaches and parents leaving due to the mismanagement by the president, disorganization and very unwelcoming atmosphere.     When are North Texas State and National going to adhere to their own by-laws and take action? Club Soccer is looking very attractive right now!

    The North Texas State Soccer and Garland Soccer Association are totally corrupt. North Texas State Soccer Association and David Arciniega are preventing directors from fulfilling their duties under the standards set by state law. NTSSA actually published information on fiduciary duty yet they do not hold their local association president, David Arciniega, responsible for running the association in compliance with state law, in a manner of good business practice, ethically or honestly. GSA is under the NTSSA tax filing and IRS charity exemption letter as part of their group. Why would NTSSA allow anything fishy to go on and risk their non-profit status? David Arciniega has brainwashed some of his long time board members into serving as his rubber stampers who defend the indefensible to protect him.

    Please read the following e-mails from the bottom up. NTSSA had already been told numerous times the ligation story shared publicly by Arciniega was a fabrication. They knew there were serious problems in GSA and the environment was hostile and secretive. Is that NTSSA lawyer now the one defending Arciniega in the suit I filed? Did that lawyer advise Arciniega to lie to his board and member Garland Soccer Association coaches about where the money was going and claim that there was ongoing litigation when none was ever filed? Did the NTSSA lawyer advise him to keep using Jevin and let them handle several hundred thousand a year when GSA had constant problems with late payments and then over 8 grand they couldn't pay us at all? Did the NTSSA lawyer ever bother to check to see if any litigation was filed as that liar Arciniega claimed? Did the NTSSA lawyer tell Arciniega to keep the board completely in the dark and refuse all documentation to board members making ordinary, reasonable and legally required requests for documentation? Did that NTSSA lawyer advise Arciniega to stop the Garland Police from investigating as he did?

    These e-mails came after months of asking NTSSA for help. Apparently, they have no problem with an association president openly violating his duties under state law, lying to the GSA member coaches about where money has gone and preventing board members from fulfilling their legal obligations to Garland Soccer. US Youth Soccer needs to exercise its authority over these entities that clearly are not following state law or their own by-laws, policies and procedures.

    I know for a fact that there was no litigation between Jevin and the online provider (Corduro). I have done an exhaustive search of all civil court records and I personally spoke to Robert Ziegler, the CEO of Corduro as I wrote to Mr. Crawford several months ago. I have asked for more information from David Arciniega and noted in my board reports the serious concerns I have about this situation. GSA board members cannot get any answers or documentation from the office as David won’t allow it and he is sweeping this whole issue under the rug.

    I have forwarded all the documentation I have to NTSSA and asked you to help GSA with this and conduct a thorough investigation so we can document what actually happened with this missing money and get some answers as to why Mr. Arciniega is telling our members / coaches litigation is on-going when that is clearly not factual. And, for the record, court documents are public record and anyone can access them, so if there was a case it would likely be in the media and highly publicized. GSA is letting Jevin handle hundreds of thousands of dollars when they have a history of late and missing payments. Why would Mr. Arciniega not get verifiable documentation on this and provide it to the board?

    I have already been brought up on phony charges of placing a son on his father’s team and after the money issue I was harassed with a lie-filled No Confidence vote. GSA has no whistle blowers policies in place and board members and office staff are afraid. I feel it is high time that NTSSA exercise jurisdiction over GSA. Financial irregularities and the flagrant misapplication of bylaws to harass board members that are asking pertinent questions should not be tolerated.

    North Texas Soccer is not in possession of any documentation between Garland Soccer Association and the North Texas attorneys. I have contacted the North Texas attorney, and he stated that he recalled a conversation with Mr. Arciniega several months ago, but said Mr. Arciniega was just seeking some advice on how to handle a matter.

    I can say from experience, that if there is or was ongoing litigation, it would be normal to not discuss the details of that litigation in a public forum.

    If you seek more information than the above and still want to speak with the attorney, I suggest you either speak with Mr. Arciniega or your board to get authorization to incur the legal fees that will be invoiced to Garland Soccer Association by the attorney, as a separate client of the legal firm.

Following is the quote of what David Arciniega said at the September 2013 general coaches meeting and that was mailed out to our coaches in November in the meeting minutes:

    “GSA receives it largest income from the registration fees so all income must match the data in the Jevin System daily. Jevin/online provider owed GSA $8,061 (in June 2013) which was paid in full to GSA as of August 20th. To compensate GSA for this delay, Jevin will lower its rates resulting in additional revenue for GSA. Litigation is on-going between the online provider and Jevin so additional information may not be divulged per the North Texas lawyers.”

    The Garland Soccer Association board members have not seen proper documentation on this issue. In order to fulfill my duties as a fiduciary of the corporation I need verifiable documentation on this issue and would like for all correspondence and court records related to this that are in the possession of the NTSSA lawyers to be made available to the board members.

    From another director 19 months after we were "hired" and after numerous requests:

    How long do the new board members have to wait to get shirts. Its hard for us to be identified if we
    are not known. Would make it easier when they are on there games for parents and coaches to know
    they are there. Might stop a lot of issues.. I know of 4 members that need them.
    2 years of very hard labor. I worked like a dog. Arciniega couldn't even get shirts for the volunteers so coaches and parents could identify us and come for help?

    NTSSA includes the board member reports with the minutes and sends those out to every association every month. Board meeting minutes and board member reports of a public charity should not be secret as those in Garland are. I asked for copies of all my board reports as some did not get sent to my e-mail box and shockingly the office people had never see them and Don Starkey ignored by polite requests for my own reports. This secrecy and subterfuge must be stopped. I wanted my coaches to know about everything I did. I was elected at large to serve them. I did not work for dictator David Arciniega!

    1 I am concerned with the money spent on national trips. Perhaps, those funds should be redirected toward doing more to retain the referees, and offering more education and support for the coac hes and parents. What about an end of season barbecue for all the volunteers so we can all get to know one another better, enhance communication and thank them for their service?
    3 I would like to see all age group directors consider sending out a mass e-mail to all the registered players, so the parents would know who to go to for assistance. Opening the lines of communication might help retain players and get problems resolved in a more satisfactory manner. We need to upgrade our customer service if we are going to compete with the other choices for soccer that are out there.

    2 I came to the April and June board meetings ready to get season dates set. I had copies of all our neighboring associations dates assembled and highlighted. In June I was told we had to delay any decision on dates as NTSSA was looking at a new software program. That should not have affected us in any way as we are already using alternative software and it might not have been prudent to migrate data and switch programs at the end of July for this fall season. Though it is often repeated that the board makes the decisions, I would say that is not correct. I was shut down and no further discussion took place on season dates in June.
    3 We closed off returning player registration on August 23. I sent out the first e-mails looking for coaches for the existing and new teams (11 total) that needed coaches on Thursday August 28th in the afternoon. I devoted the holiday weekend to desperately scrambling to get coaches.

    1 I would like to set more reasonable registration dates to coincide with those of our neighboring associations. It would make things go much smoother for interleague. Our own coaches have also asked for years to get final rosters several weeks before the seasons start in order to have time to practice and order uniforms. This season start has been very chaotic and stressful.
    2 We were short referees on opening day. What do we need to do to improve things for the referees?
    3 Plano charges $35 for the diaper league. Our U4 and U5 should get a price break perhaps since they never get a referee.

    1 Ascertain the best way to get firm figures on the number of special needs players. How many need to be referred to a TopSoccer program? How many could function in our leagues if the coaches had more info and training? Getting those numbers seems to be the next step in determining what course to take and what expenses need to be costed out.

    David Arciniega sent an autistic player out on the field in U12 when that dear child was twiddling their fingers and not watching the game and participating. He put that child in great danger. Several responsible directors and I tried to set some safety guidelines and began researching what would be needed to start a TOPsoccer program so that every child would have a league to play in where they could blossom and be safe.

    Now, that Arciniega has run me off I am sure that has been shelved so kids will continue to be put in danger and coaches will get no additional training or help to deal with special needs players. Arciniega has not been willing to turn kids away that we are unable to serve well, nor can he refer them to other programs as our registration runs way past that of other programs. Coaches quit because they are not prepared to deal with special needs players and many players on teams with those youngsters quit as it is very hard to play with a teammate that disrupts practice and is not able to fully participate on the field. Garland Soccer is a disaster and the kids and coaches are not getting what they need from the program!

    Rule changes in NTSSA may soon allow families to register their children in any association under them without getting releases. GSA better up its customer service pronto!

    GSA should get the award for the most mind numbingly boring tournaments ever hosted. Coaches and parents have said for years that GSA needed to make the tournaments more fun and appealing and nothing has changed. GSA has no sponsors, no entertainment, no atmosphere. It is exactly the same as the regular season games and very few teams bother to sign up any more. I tried everything to get attention to what our coaches and parents wanted to no avail. Why not have an awesome fun tournament for our kids???

    Notice who is in charge of fundraising. The Training and Special Events Director has never done that. President Arciniega is not seeing that the directors know what to do or seeing that the bylaws are amended by the coaches vote to reflect what should be done. The Publicity and Awards Director should be doing fundraising, but Mrs. Sex Offender has been missing in action and doing nothing from what I hear since November 2014. So, Arciniega has no trouble demanding I resign for doing my job as state law prescribes, but Mrs. Sex Offender has David Arciniega for her biggest fan plus another board member who wants GSA to be her support group. Really? GSA is a business and should be run as such.

    With David Arciniega in charge it has been mostly monkey business!!!

    Time for another reality check. I was desperately trying to save interleague in May 2013. I came to the meeting and shared that I knew for a fact that the Plano Youth Soccer Association was courting Richardson and Wylie (as in taking our interleague away to play with them.) I suggested that we host a lunch meeting and invite all our interleague associations over and see what we could do to fix the problems. I was shot down by Arciniega. I had babysat numerous games in the older age groups U11 and up for interleague teams with legitimate complaints, though I was the U6 Girls Director, because team work is the name of the game and interleague benefits all of GSA. I told the GSA board our late season start, never ending registration and total disorganization was going to cost us interleague and suggested solutions. I offered to serve on the interleague committe as I had gotten well acquainted with many of the coaches, but once again Arciniega shot me down. GSA president David Arciniega and many of the board members just snickered about this whole issue. Arciniega did proclaim that Richardson teams would never drive to Plano. Well.....guess what!!

    As to my source, it was the wonderful man who took my boys team over. He had coached in Richardson and Plano for years and was then coaching the University of Texas at Arlington girls and a Plano girls team (he had no child on that team for the record.) He had served on the boards of those other associations and regularly attended their meetings. He saw how poorly run Garland was and ran for president that month. If David Arciniega hadn't had his proxies come marching in, this wonderful coach would be leading Garland Soccer now and I am sure it would be growing and thriving under his leadership.

    Starkey and the rubber stampers, who blindly follow Arciniega might want to reconsider who and what the real problems are. I was trying to save interleague. The board as usual did nothing. David Arciniega hired the interleague committee months later after he already knew that those associations had left. He set them up to fail and let them take the blame for his own folly. Arciniega never gets his own hands dirty!

    I am sure we elected an Interleague Committee months ago that is/was capable of interfacing with outside Associations. You might check with the Chairman and see what actions have been taken to date in regards to your "legitimate concerns".
    If you have "legitimate" information sources, name them, otherwise they don't seem very reliable. It doesn't allow for those that may wish to follow up on the information you're offering much to go on. We all have plenty to do (or most of us anyway) without chasing rumors.
    Also, there's no need for you to always throw David under the bus with your commentaries. Decisions are made by the Board, not by the President, so give the incessant attempts to discredit the President and the rest of the Board a rest, please.

    Plano Youth Soccer is pleased to welcome 19 teams from Wylie Youth Soccer and 3 teams from Rockwall, joining us for the spring 2014 season. The teams will boost our U12B league by 7 teams, U12G by 10 teams, U14B by 2 teams, and U14G and U19B by 1 team each.

    PYSA has long been a host for out-of-town teams from Allen, Frisco, McKinney and other cities in the U16 and u19 leagues, making those league among the strongest in North Texas. Our engagement with Wylie includes playing some games at Founders Park in Wylie. The park is approximately 22 miles and 28 minutes from Carpenter Park. Our goal was to avoid weeknight games between Plano and Wylie teams. While we fell a bit short of that target, the impact to most teams has been minimized. We continue to look for ways to make this endeavor as painless as possible.

    Having more teams in our leagues allows for the division of age groups along skill level lines. Being able to have teams play other teams of like skill level is a key goal for the PYSA recreational league. This approach gives teams and players the best opportunity to develop and grow their skills at their own pace. It also gives every team an opportunity to have competitive success, which makes the soccer experience much more enjoyable.

    Adding teams, promotion and relegation between the fall and spring seasons, and encouraging our best teams to “play up” when their skill-levels are above their age-group peers are all ways that PYSA looks to manage that “competitive balance” in order to bring teams of like skill levels together.

    The PYSA Recreational Coaches’ Panel advised us throughout this process. The group is an ad hoc panel of PYSA rec coaches brought together to discuss key issues facing PYSA. They were instrumental in our decision to move forward with bringing Wylie and Rockwall teams into PYSA.

    PYSA is always looking for opportunities to improve your soccer experience. We understand there are tradeoffs with this particular effort related to travel, but we believe that the net benefit for our teams and players outweighs a few extra minutes of drive time a few times a season.

    Dear North Texas board members and office staff,

    I am respectfully requesting that North Texas exercise jurisdiction over the Garland Soccer Association and conduct a thorough investigation into the missing funds. It is also imperative that the phony charges filed against me and the U12 director and the no-confidence vote (brought against me for seeking proper documentation related to the missing funds and taking the appropriate action by reporting these missing funds to the proper authorities) be evaluated in relation to their validity and adherence to proper protocol and procedure as prescribed in our by-laws.

    2.2.6 Jurisdiction
    This Association shall have jurisdiction over all Member Associations’ administrators, referees,
    coaches, assistant coaches, managers registered players and teams affiliated with it. Each Member
    Association shall retain its own autonomy, but will adhere to its Bylaws and Rules and Regulations
    and will comply with the authority of the Association. If the Association is presented sufficient
    evidence that a Member Association is not adhering to its Bylaws and Rules and Regulations, the
    Association may form a committee to investigate the allegations and make recommendations to the
    Executive Committee to correct the infraction(s). If gross misuse of funds, misapplication of
    Bylaws, or misapplication of rules and regulations is discovered, the Member Association shall be
    declared not in good standing and given sixty (60) days to correct the situation, or the Association
    may take more immediate action if deemed necessary by the Executive Committee.

    Please see the accompanying documents attached. Note the executive committee completely and unnecessarily bypassed the board. They agreed to a discount on future withholdings by Jevin to repay over $8,000.00 of missing payments from the spring 2013 soccer season. Jevin, already had a history of late payments and issues. The payment processor Corduro was the convenient scapegoat for this missing money without a shred of documentation to substantiate that they were in any way responsible. The story that Jevin couldn’t get a loan to pay GSA the money owed is beyond laughable. That suggests that Jevin has serious financial concerns as they cannot qualify for a small business loan among many other possibilities.

    Another director pointed out the obvious at our monthly meeting in July 2013. This whole financial issue is fraud plain and simple. The first step (which I in fact took) should have been to go to authorities as it cost nothing and was personally recommended to me by my licensed attorney and a forensic fraud investigator. When I took that proper step of going to our local police, I was attacked by the board and David Arciniega told the police and the board that any talk of these missing payments was “unfounded.” What we have been writing and saying about Corduro, for months without any verifiable documentation amounts to libel and slander. And, reduced fees do not address the critical issue of who was responsible for the late and missing payments to begin with and why anyone might wish to cover up that problem.

    The second page of the attachment shows Jevin’s glowing testimonial about Corduro. They claim they are getting funds the next day from Corduro. Next, I have included my August board report. I documented in writing the information we had been given by David Arciniega. In July when I asked for more information about the missing payments from Jevin, David Arciniega went on about $50,000.00 in losses he claimed Jevin suffered due to Corduro. I was horrified to think other non-profits and businesses might have been harmed and continue to face losses due to Corduro and that GSA was taking no action. I questioned why Jevin didn’t go to the authorities and why they were filing a court case in lieu of a free investigation by the police. I also questioned how Jevin could fund a court case if they couldn’t pay GSA the 8 grand owed or even qualify for a loan. I am very concerned that we are continuing to do business with Jevin when we have no verifiable documentation about any of this.

    The November General Coaches Meeting minutes follow. Following is the quote of what David Arciniega said at the September meeting:

    “GSA receives it largest income from the registration fees so all income must match the data in the Jevin System daily. Jevin/online provider owed GSA $8,061 (in June 2013) which was paid in full to GSA as of August 20th. To compensate GSA for this delay, Jevin will lower its rates resulting in additional revenue for GSA. Litigation is on-going between the online provider and Jevin so additional information may not be divulged per the North Texas lawyers.”

    Why is this misinformation being sent out to our coaches? Board members have asked for proper documentation for months and none has been forthcoming. The president and executive committee members must be aware at this juncture that the court case is pure fiction. I need the contact information for the North Texas lawyers to be forwarded to me immediately, so that any records they have related to this financial fraud can be accessed by the GSA board members seeking clarification on this matter. The GSA board must make decisions based on verifiable fact and not rumor, innuendo and hearsay.

    I checked with Collin County (where Jevin is located), Dallas County and Tarrant County (where Corduro is based) and confirmed there was never any action filed. Knowing that, I went to Corduro to get their side of the story as should have been done by the leadership of GSA in the beginning. The CEO and president of Corduro, Robert Ziegler, generously offered to speak with me and respond to my request for information in writing. Said correspondence is attached. Mr. Ziegler indicated that Jevin and Corduro had parted ways amicably a year ago. He stated that Corduro does not owe Jevin any money, much less the $50,000.00 claimed by David Arciniega. Jevin never threatened or filed any litigation against them. And, no investigations by law enforcement were conducted to his knowledge. So, GSA, David Arciniega and NTSSA by association have been libeling and slandering Corduro and frankly we are fortunate that Mr. Ziegler is not pursuing any litigation against us at this time in light of the wild tales that have been told regarding his company.

    The actions of the GSA president and executive committee defy logic. We are a charitable organization and everything we do should be well documented and completely transparent. We are to be the good stewards of the funds of the families of Garland that come to us. I have been asking for open meetings and proper documentation, all of which constitutes normal procedure and ordinary care for a board member that is executing their legal obligations and duties. Our president is still advising people they are not welcome at board meetings and operating this public charity under a veil of secrecy.

    To allow continual harassment and retaliation against board members that are making ordinary and necessary request for proper documentation related to financial and other matters is reprehensible and must be addressed. The phony charges and No Confidence vote filed against me are nothing but a dirty tactic employed by our president and vice president to scare off board members who ask questions and demand that business be conducted openly and above board.

    I have no intention of tolerating any more nonsense and will get my attorney and the media involved if I am subjected to any further abuse and retaliatory measures. That is precisely why I have come to North Texas for help. The GSA board is no longer able to fulfill its mission with the secrecy, lies, and misinformation being spread. This board and office cannot function when members and employees fear reprisal and retaliation by the leadership when they are simply trying in good faith to carry out their jobs. We have a board where members are afraid to stand up and do the right things as the leadership has made it clear what will happen to those who ask too many questions or don’t follow the wishes of the president.

    Again, I respectfully request a full investigation into the financial dealings within GSA and the obvious attempts at bullying and harassing board members who are working hard to serve our member families. We board members come from various professions and backgrounds and a scandal involving financial fraud would seriously harm our personal reputations and even our livelihoods in some cases. This issue effects the good standing of GSA and North Texas and needs to be addressed immediately. I look forward to your response by the 23rd please.

    Lie-filled No Confidence Vote

    The missing money was an issue from the summer of 2013. I got attacked with a lie-filled and totally unethical No Confidence vote that claimed I should be removed for asking questions of and making necessary reports to NTSSA in September 2013. North Texas set me up to be intimidated and harassed by not abiding by their own Whistleblower Policy. Please also note that the president of US Youth Soccer is copied on this letter. Youth soccer is clearly in crisis!

    I certainly don't want this director Crystal Martin and her husband anywhere near our Garland kids. He handled rosters at the general coaches' meetings. He left the library with my age group's sign in sheet, rosters and comment sheets. He drove in the Garland Labor Day Parade and hung around the fields. She was volunteering even though their family business was failing and they couldn't pay for their home. That is a huge red flag!

    David Arciniega defends this director staying in office even though she hid that her husband was a dangerous offender and she is unable to drive herself. Her legal duties to the charity demanded she make this known to the board. When I reported this dangerous offender and his errant wife to the Garland Soccer Vice President and North Texas I was outed. The Whistleblower policy was ignored. That could have put my family in danger when I was desperately trying to keep our Garland kids safe!
