    Dishonesty Exclusion Precludes Coverage for Claim Based in Part Upon Knowingly Wrongful or Fraudulent Acts

    The dishonesty exclusion precluded coverage for claims “based in whole or in part on any knowingly wrongful, dishonest, fraudulent, criminal or malicious act committed by or at the direction of any ‘Insured' in the course of providing ‘professional services.'” The policyholder conceded that the complaint, at least in part, alleged fraud and knowingly wrongful acts, but argued that the insurer nonetheless had a duty to defend because the complaint could be construed as also alleging negligence. The court disagreed, attaching importance to the language “in whole or in part” in the exclusion. Because at least some of the allegations in the complaint were based on knowingly wrongful, dishonest or fraudulent acts, the insurer lacked a duty to defend notwithstanding other allegations of arguably negligent conduct.
    It will be delightful to see how the Pullen Insurance policy reads and see if they deny David Arciniega coverage. The board should definitely have its own attorney and be looking out for the interest of the charity and not continuing to be tangled up with Arciniega.

    Chris Kotschi called me from her office at 6:45. She thinks they will be scheduling a hearing for our cases as she has looked at the paperwork. She had not seen Kaeli’s appeal, but will ask for that and look at it tomorrow. She seemed quite surprised that we were not allowed to see David’s report to NTSSA about Kaeli and our team formation practices.

    Chris Kotschi told me we would get a hearing on the phony A & D charges because of the many blatant by-law violations by Arciniega. A Board Hearing is a procedure cooked up by Arciniega to harass me and my fellow director. The board is always the first level of appeal in an A & D process and never the starting point. Also a decision letter is required after an A & D regardless of the outcome. David Arciniega refused to produce one in an effort to stop us from appealing. The decision letter is what is needed to appeal.

    David Arciniega looked shocked when I went lawyer on him and came in with a 132 page response at the phony Board Hearing and handed them out to all the board members, so he was desperately trying to keep me from getting an appeal at North Texas State Soccer. I quoted numerous by-laws that had been violated and nailed him on the fact he had no evidence. My fellow director and I had nothing to do with the placement of that player in any way and couldn't have as all player assignments are handled by the player pool alone (except in rare circumstance of a player getting approval to play up with a sibling or down because of a medical issue etc.)

    Arciniega's refusal to produce a decision letter puts GSA NOT in good standing.
    I did not get the required decision letter and the other violations were not addressed. So, according to the NTSSA (North Texas State Soccer Association by-laws GSA is not in good standing.

    2.1.3
    Good Standing of Member Association
    To be in good standing in the Association, a Member Association
    must meet all of the following requirements:
    (1-4 redacted)
    5.Member Associations will provide equitable and prompt hearing and appeal procedures to guarantee the rights of individuals to participate and compete and insure due process to the accused. In all hearings conducted, the parties shall be accorded:


    • a.Notice of all specific charges or alleged violations in writing and possible


    consequences if the charges are found to be true;


    • b.Reasonable time between receipt of the notice of charges and the hearing within which


    to prepare a defense;


    • c.The right to have the hearing conducted at a time and place so as to make it practicable


    for the person charged to attend;


    • d.A hearing before a disinterested and impartial body of fact finders;
    • e.The right to be assisted in the preparation of one’s case at the hearing;
    • f.The right to call witnesses and present oral and written evidence and argument; Notice


    of all specific charges or alleged violations in writing


    • g.The right to confront witnesses, including the right to be provided the identity of


    witnesses in advance of the hearing if requested;



    • h.The right to have a record made of the hearing if requested in advance, with all costs


    to be paid by the requester;
    i.
    A written decision, with the reasons for the decision, based solely on the evidence of

    record issued in a timely fashion and including appeal rights and procedures.
    j.

    Notice of any substantive and material action of the hearing panel in the course of the

    proceedings.


    • k.Equality concerning communications and no ex parte communication is permitted


    between a party and any person involved in making a decision or procedural
    determination except to provide explanations involving procedures to be followed.


    6.Member Associations will, at all times, recognize the authority, rules, rulings, constitution and

    bylaws of the Association, which comply with the authority of the United States Soccer
    Federation, and its National Associations of which North Texas State Soccer Association is a
    member.


    7.Failure to comply with one or more of the Subsections 1–6 Section 2.1.3, will result in the

    Executive Committee determining the Member Association is not in good standing. Failure to
    be in good standing is further defined as meaning players and teams registered through the

    Member Association will not be allowed to participate in any tournament/event sponsored or
    sanctioned by NTSSA, nor will they be certified to play outside of the NTSSA in any games,

    tournaments or other competitions for which they might have been otherwise eligible. The

    Member Association may not vote on any matter at any meeting of the Association while it is
    not in good standing.


    8.A Member Association failing to meet any requirements of good standing for a period of sixty

    (60) days shall have its territory declared open and shall not be entitled to vote or to any

    protection, services or competitions of this Association.

    The hearings Chris Kotschi said we were to have scheduled never happened because the good ol' boy network came into play.

    David's buddy, Carlos Quinones, flagrantly violated all the rules and protected David Arciniega from being held accountable. North Texas is corrupt and the scandals like those at FIFA are happening at all levels of soccer. As I had no decision letter and couldn't appeal I filed grievances with North Texas and US Youth Soccer. I intend to fight until it is cleaned up. The scandal at North Texas involves more as there have been complaints of David Arciniega being protected and given preferential treatment for years.

    Carlos Quinones has had complaints coming his way, but obviously from his own board report there are almost no hearings taking place. I am not the only member that was denied their rights under the by-laws.


    The media has interviewed me 3 times since June. How much more bad publicity are North Texas, US Youth and Garland Soccer going to generate???

    Please note that NTSSA minutes are public and available. David Arciniega keeps those for Garland Soccer secret and if one must have them, he colors most of the information out. It is high time scammer Arciniega get the boot and the honest and transparent running of GSA begins.

    From the November 2014 minutes:





    The fall 2014 advertising did not help Garland Soccer. GSA had 234 teams. As Arciniega forced me out and continued to shut the coaches down and carry on with his antics the team count dropped to 207 in spring 2015(usually in the spring there is quite an increase in numbers.) Then the numbers plummeted further in fall 2015 and only 192 teams hail from Garland today. The rule change allowing players to register wherever they wish happened late in July, so teams that wanted to leave were not all able bail. By spring 2016 the rule change will see many more teams leave.

    The Major League is disappearing and the short rostered teams are having a horrible season and in other divisions they are stuck playing the same teams 3, 4 or even 5 times each. Arciniega has also consistently refused to host a Spanish version of the website when 49% of the students in GISD are in fact Hispanic. That is hurting numbers and fostering a negative relationship with the community as well. David Arciniega has done serious damage to Garland Soccer and is driving the taxpayers of Garland to spend their time and money playing in other cities.

    I was around GSA for 20+ years. David Arceniega is without question, the biggest slime ball I have ever come across in the soccer world, he makes Hilary Clinton look like mother Teresa.

    Putting aside the Sex Crimes, the missing funds, the bogus elections, he just conducts himself in a way that is slimy. He has surrounded himself with slime ball constituents, and it is quiet easy to tell which one those are, if they have been on the board for over 8+ years, then they are one. Those that don't follow him blindly, are pushed out.

    At 7:02 I got a threatening phone call. Some lowlife male with a low resonant voice said, "take it down." I of course answered with, "pardon me...take down what" as the idiot hung up. I blog about numerous lovely topics, so which one was it? And, anyone who has read me knows the more annoyed that I am the more snarky my posts become. As it could well be some member of David Arciniega's fan club I will naturally be giving this topic a lot more attention!

    The Texas State Bar says:

    ...the lawyer also must avoid furthering the client’s unlawful purpose, for example, by suggesting how it might be concealed. A lawyer may not continue assisting a client in conduct that the lawyer originally supposes is legally proper but then discovers is criminal or fraudulent. Withdrawal from the representation, therefore, may be required.....Withdrawal is also justified if the client persists in a course of action that the lawyer reasonably believes is criminal or fraudulent, for a lawyer is not required to be associated with such conduct.....

    a lawyer shall not knowingly:
    (a) make a false statement of material fact
    or law to a third person; or
    (b) fail to disclose a material fact to a third person when disclosure is necessary to avoid making the lawyer a party to a criminal act or knowingly assisting a fraudulent act

    Rule 8.04 Misconduct
    (a) A lawyer shall not:
    (2) commit a serious crime or commit any other criminal act that reflects adversely on the lawyers honesty, trustworthiness or fitness as a lawyer in other respects;
    (3) engage in conduct involving dishonesty, fraud, deceit or misrepresentation;.....
    The discovery is still overdue. I turned over 1300 pages and meaningful responses. David Arciniega and the former attorney quoted 1 by-law turned over no documents. Will these new attorneys allow Arciniega to continue to lie and conceal information? Will the new attorneys allow David Arciniega to keep the board (which has the sole power to run the organization) in the dark and continue his antics?

    Dear Mr. Martella,
    Thank you so much for making the time to speak with me. Garland Soccer is in crisis and US Youth Soccer very much needs to investigate and take appropriate action.
    My son has a serious chronic medical condition and is tube fed elemental formula. He had to quit playing soccer after 6 wonderful years in November 2012. I had taken the F Clinic and coached a U12 team with him to keep it from being folded. As he was very sick, I needed to find a new coach for the team that spring. When the new head coach came in his son was placed on the team by the player pool. David Arciniega filed phony A & D charges against me and the U12 director and took us before a “board hearing” because he claimed we had “instructed” in the placement of a player and coach. There is no such thing as a board hearing as that is the level of appeal for an A & D charge. We have nothing to do with the player pool and would not be able to contact them. Why in the world would GSA not put children of the correct age with their coaching parents??? Why were we given no decision letter after NTSSA made it clear it is required? Why was our grievance not heard as we could not appeal without a letter?

    There was serious conflict over having open board meetings. Proper documentation was routinely denied to the board by president Arciniega. David Arciniega would not respond to legitimate complaints from associations playing interleague with us and now Richardson, Wylie and Chamber Classic are gone and Plano will not invite us to join them. Our registration is unlike any other association’s and our seasons almost always start late and are very chaotic and unorganized. Our major league will not be able to play soon due to the low number of remaining teams. Our overall numbers keep dropping as well as coaches and parents are unhappy and leave.

    When over 8 thousand dollars went missing Arciniega refused to provide the board any documentation whatsoever. He proceeded to lie to the coaches and spun a ridiculous tale about the software provider Jevin couldn’t pay us because of the payment processor Corduro. Arciniega brayed to the member coaches about Jevin having sued Corduro and that the litigation was ongoing and that the NTSSA lawyers said it must be kept secret. Since when is deliberately lying to the coaches acceptable? Several directors tried for the last 2 years to get answers on this.

    I was brought up on a No Confidence Petition in August 2013 because in the May 2013 election I had spoken for the candidate running against Arciniega, demanded documentation on a serious money issue and had asked questions and filed a grievances with NTSSA in response to the A & D charges and other pressing issues. That was nothing more than pure harassment for doing my job as state law requires.
    Elections have been rigged for years. That should be investigated, but filing a formal complaint with the VP was once again useless. She is afraid of David Arciniega and is prevented from doing her job. No action was taken and the VP knows that she can’t go to NTSSA for help. Arciniega can do whatever he wishes and knows he will never be held accountable.

    I reported that a dangerous sex offender was married to a director who could not drive and that she was letting him handle rosters and other records and David Arciniega and NTSSA proceeded to out me to this dangerous offender in violation of the Whistleblowers Policy. The board is a hostile environment and Arciniega has always run it like a dictatorship.

    The director with the sex offender husband had many more serious issues of which Arciniega was aware. Her home mysteriously burned down in 2013. She was bragging then of David Arciniega meeting her and her husband about doing construction work for GSA. My family decided to test out their business. They were paid in full for a stone job at our home. They had not costed that small job out correctly and we had to write another check so that they could purchase the materials to finish the job. I searched permits and the BBB and other sites and talked to many former customers who had paid them thousands of dollars only to have the money lost as the (&*^% left the jobs in shambles and unfinished. One customer told me of Mr. )*(&^’s sex offender status..... the whistleblower’s policy had been once again ignored and I was outed to this dangerous offender and his wife....... NTSSA refused my request and I was intimidated again. So, are NTSSA and Arciniega going to actively discourage folks from cooperating with law enforcement now?

    I sent in a formal request for the Vice President to check the attendance records of a director that it turned out had missed 62% of the meetings and see if she had to be removed as the by-laws state. I had sent my concern only to the VP. She forwarded it to Arciniega. He made sure the director in question got it and she publicly attacked me outside the field house during our fall tournament while David Arciniega looked on apparently amused. Once again he lied and told everyone present that I had sent it to the whole board. I told him that was nonsense and that these antics must stop. There is no ethics committee in GSA though the by-laws state one must be formed. The VP is terrified of Arciniega and once again would not file charges against him.

    The infighting on the Garland Soccer board is destroying that association. Several of my then fellow directors were well aware of the lawsuit. They know the allegations are factual. They know the US Youth by-laws state Arciniega shall be removed. That should finally spur a real investigation into what has been going on in GSA and NTSSA. If the dishonest leadership gets removed perhaps those of us who truly care about these kids and coaches can save what is left and rebuild relationships with the neighboring associations so the major league players will still be able to play. It is inexcusable that these serious problems have been allowed to go unchecked for years.

    There are so many serious challenges facing GSA Please complete the investigation that Mr. Sutter said was underway. There are many people with information that US Youth should be talking to. When is US Youth going to follow up with me for the names of those folks and for clarification and further documentation?

    US Youth Soccer does not follow its own by-laws. It does not complete investigations that is says are ongoing. And, in order to prevent appeals they are not issuing written decisions. Totally mismanaged and corrupt! Removing these Facebook posts is not getting these issues resolved!

    I spent lots of time with my boys team over at the Indoor Soccer Zone during off season and for fun pick-up games. Around 30 Garland coaches would be there during any given season. A group of Garland Soccer parents and coaches came running up to me and asked for help. A Garland Coach was being accused of not inviting a player to the tournament and soon after was accused of having 2 illegal players. He didn't want to go to his hearing even after we all begged him to do so. He signed a power of attorney for me to go in his place and represent him in that matter and any related appeals. Thankfully, on the day of the hearing he decided to go. Normally, as a director I would not be involved as I would be on the panel (the next level of appeal,) but as I was already tainted I was glad to help him.

    That coaches in Garland don't want to go to A & D hearings because they know they may be railroaded and that the hearings are not fair. The broken and corrupt A & D process is running off Garland coaches and players. This coach got railroaded and left GSA to play elsewhere. He considered appealing, but decided he would just rather get out as it is such a miserable experience playing in Garland and it is such poorly run association. I had helped him prepare his appeal:
    I am requesting a board appeal of my A & D decisions for the following reasons:

    1. This A & D did not follow the rules. According to GSA Rule # 11 A. 1, the investigation must include an interview with the accused to determine if charges will be filed. I was not called or e-mailed. I found out I had been charged in the first letter I received that was dated June 5th. That letter mentioned only 1 charge. I was accused of not inviting a player to the tournament.
    2. I received only the letters and nothing else. I got no documentation. I was not able to prepare my defense well. Doesn’t the evidence on record against me have to be included with the letter?
    3. I questioned why I was being charged when I had done nothing wrong. I said that I didn’t think the A & D process followed the GSA rules and the charges against me should be dismissed immediately. That resulted in yet another letter and more charges. My daughter and her friend were then brought up on charges for playing for 2 teams. I was brought up on charges for having them on 2 teams and our team could have all their games forfeited according to the letter. I feel like this was in retaliation for questioning how the A & D was being done. Where did these charges come from in July? That is a fishing expedition.
    4. I received my second letter on July 8, 2014. That was only two days before my hearing which was scheduled for July 10th. The NTSSA A & D Manuel page 12 states that 7 days minimum from the time the letter is received should be allowed for the accused to prepare a defense.
    5. When I again questioned how the A & D was being done at the hearing I was immediately shut down by the Vice President, Piney Burch-Walser.
    6. I was found in violation of the following rule:
      “RULE 6. ELIGIBILITY REQUIREMENTS
      A. Standard Registration Forms:Players must be registered with only one team at a time, except for players who may also be members of official school teams. All registration documentation must be complete and submitted to the Association 48 hours prior to the first regular season game.”

      I understood that to mean my daughter could only play on 1 GSA team. I had no idea that I was violating any rule. Lots of kids play on other indoor and outdoor teams. Is it fair to punish a coach with suspension and the players with a forfeit of all their games for violating a rule that is not clear?
    7. Jared Hirschowitz at 904 521-6083 / Jared@gotsport.com confirmed that if GSA was using GotSoccer as NTSSA and the other associations under them are, then the girls would have been flagged the minute they showed up as registered for a second team in NTSSA. I shouldn’t be punished when the software was not flagging the players. The girls played on 2 teams all year and it was never flagged.


      My whole team had all of their games forfeited because of my mistake. Why are the kids being punished for my mistake? I respectfully request that the decisions against me be set aside and that my girls get the trophies that they earned.
    I had called Jared for him. David Arciniega was made aware of this horrific problem numerous times, but insisted on staying with the Jevin software. Why use a software provider that left the board worried about financial fraud (as Arciniega refused to produce any records) and one that doesn't interface with GotSoccer and catch duplicate registrations? These kids and coaches are brought up on charges for something that using Got Soccer would solve. Got Soccer would register them for select and then if any player tried to register for a second team such as Garland Soccer's recreational program, then they would be tagged and blocked. There is a reason that virtually all the other associations use GotSoccer and that GSA is the only one using Jevin. The corrupt president, David Arciniega and his VPs that are abusing the A & D process need to be removed! Both VP, Burch-Walser, and the corrupt president shut down the coaches and refuse to hear their pleas that the rules and by-laws are not being followed. The VP was furious with me for helping this coach, but North Texas guarantees their right to help in preparing for their hearings and I knew that wasn't happening. I was there for the coaches and the kids all the way!

    A: The Wylie Cup is an annual tournament, played at the end of the fall season. For U9 and above teams, this tournament will determine which teams will represent Wylie in the Tournament of Champions. For U7/U8 teams, The Cup is a fun and exciting way to end the season and give the players a tournament experience. The U4-U6 teams will play the last two games of their 10 game season on this Saturday, surrounded by the exciting atmosphere created by the DJ, the vendors, and the competition on the fields.

    Q: Who can play in The Cup?
    A: The Cup is open to all WYSA Fall recreational teams.

    Q: How much does The Cup cost?
    A: The Cup is provided at no additional charge to the player, team, or coach.

    Q: I only have enough referee money left to cover two games. How will referees be paid during The Cup?
    A: For U5/U6 teams, there will only be two games so this is not an issue. For all other teams, coaches will receive additional referee fees at registration.

    Garland Soccer is shrinking and totally mismanaged. The tournaments are very boring and expensive to enter compared to free! Though numerous coaches and parents have complained and several board members and I noted it in our reports and tried to make changes, nothing has been done to improve the Garland Cup. So, there is no music, no atmosphere, no decorations, no vendors save for Children's Medical Center in the past and no referees for the younger teams. The tournament is indistinguishable from the regular season games and the number of teams participating has been dropping dramatically. It is obvious why the numbers are plummeting in Garland. David Arciniega blocks any effort to improve things unless it is his own personal agenda. The coaches and families are ignored and the board is completely powerless.

    Garland players have the option to register in whatever association they wish. David Arciniega can no longer refuse to sign releases as all players have to do is fill out a 1 page online form that is free of charge now! Mesquite, Richardson, Plano, Wylie and many more in the area have fantastic programs and incredibly good customer service!

    Darcene "Darcy" Quintana phoned me last night. This former Publicity and Awards Director for Garland Soccer had apparently just read my e-mail about the poorly planned and boring Garland Soccer Tournament as contrasted with the incredible tournament put on by GSA's former interleague partner association, Wylie Soccer Association. I was told my informative e-mails were harassment. Apparently, she was unaware of the unsubscribe button and as I offered to take care of that for her she hung up on me.

    Quintana was a long time board member. Her husband Erick Renato Quintana Carias is a long time coach and referee in the association. They have been blind followers of David Arciniega for years. David Arciniega is brilliant. He never gets his hands dirty. The clueless Vice President Kim Verity is the one who put her name on the No Confidence vote. The No Confidence vote had to have member coaches signatures according to the by-laws. So, 2 directors, Juan Ramirez and Crystal Martin (Mrs. Sex Offender who couldn't drive) were asked to sign as they were also coaches. Quintana and another director had their husbands sign as they were not head coaches and could not sign themselves.

    State laws concerning non-profit corporations dictate that each director act in the best interest of the corporation. That means that I as a director had a legal obligation to vote for the most qualified candidate for president. The wonderful coach that took over my son's team when his chronic illness became too severe for him to ever play again ran for president. This coach, Dan Medina, did a fantastic job of working with our special needs player, coached a college girl's team and had experience on other local association boards. I supported him and was 1 of 3 that spoke on his behalf at the election. I was bound by state law to vote for him as he was the best leader available for GSA and had the absolute right as a member of the charity to vote for the candidate I wished.

    Erick Quintana signing a No Confidence Petition to remove me for voting as state law and my conscience dictates is unethical, immoral and an attempt to prevent me from doing my duties as prescribed by state law. Quintana signed that knowing it would be mailed out to all the members of the charity (Garland Soccer Association) and be decided at a public meeting. He should have read that lie-filled garbage before signing it. Quintana had to know I would defend myself publicly. So, if the Quintanas are unhappy about this they should hold David Arciniega accountable. They chose to get involved in this conflict. Arciniega was coaching a team and could have signed, but he was smart enough to get all these folks to do his dirty work for him.

    As Quintana signed that egregious No Confidence Petition, he should not be allowed to serve as a referee. How can the coaches trust him to make unbiased, fair calls in light of this unethical and immoral behavior? All those who signed the petition should be brought up on charges and removed from participating in soccer.

    Many coaches don't attend meetings. Why bother when it is obvious the elections are rigged and those that don't vote for Arciniega are publicly attacked and harassed as I was.

    This was the last and the only association that sent all their older age group girls' teams and a boys' team over to play interleague with GSA. The few other teams from other associations were apparently stray teams that missed deadlines in Plano and the other associations where the rest of their own association teams were playing. Notice that Rowlett is registering for spring already. Arciniega won't even let the Garland Soccer board discuss registration for spring until the December board meetings.

    Garland is never ready to play on time and every season start is totally unorganized and chaotic. All the neighboring associations close registration weeks before the start of the next season and coaches get final rosters weeks before the season starts. Garland dumps players through the 5th game and leave coaches dealing with new players and buying uniforms sometimes 4 times per season. Coaches and players leave in droves each season after a miserable experience and disastrous season. The board is powerless to change things with dictator Arciniega in charge.

    The question is will Rowlett continue to send teams over to this imploding association with a board that is infighting and prevented by Arciniega from running the association. Will they want to to be tangled up with Garland and Arciniega as they fight the ongoing litigation with me? Arciniega is still turning over nothing with the discovery months overdue and I suspect the board has no clue how the case is progressing. I bet that Arciniega is preparing to throw the Garland Soccer board under the bus. He has done it before! There is no way to know if Arciniega will be removed by US Youth and / or North Texas or if the city of Garland will decide to take action and deny Garland Soccer the use of the city fields in light of what is going on.

    Proof positive that the elections are rigged. All those in red voted to put me up on a No Confidence vote at that meeting. I have a legal obligation and every right to vote as I wish. Garland member coaches live in fear of retaliation, intimidation and harassment. They know they can't vote as they wish and that the elections are dirty due to tactics like this and referees coming in with proxies having been instructed to vote for specific candidates.

    All those directors in red that voted in favor of this blatant harassment and intimidation should be brought up on formal charges and suspended or banned from all soccer activities. Garland Soccer ignores state law concerning non-profits and certainly is not run as a legitimate charitable organization.

    Referees Kathleen Robinson and Don Starkey should not be allowed to referee any longer as it is clear they use poor judgment and can be manipulated into doing things that are totally unethical and immoral.

    Hilarious! When I encouraged my coaches in the U6 division to fill their rosters with assistants, managers and team moms so that background checked folks would be with the kids at all times I was viciously attacked for it. David Arciniega had all the directors air their feelings at a meeting and I have no doubt that he was behind Angela Bowen-Hearn attacking me for doing the right thing to protect the kids. Now, that Arciniega and the board look as clueless and corrupt, there has been a complete 180 and the things I pushed for such as ID cards and background checked adults are being supported by Arciniega's stooges.

    And, why did the board not address the rest of that rule. Is GSA going to bring every coach in U9 and above up on A & D charges that instructs from the sidelines? I pointed that problem out as well.

    When is this board that is supposed to be running this charity going to turn over the discovery that was due on August 21st? Arciniega (who is obviously still the out of control dictator in charge) has as of today turned over zero documents. What does the dubious dictator have to hide? Why did the board look the other way when Arciniega lied to the North Texas attorney as evidenced by the filings he made before he bailed? Why are they not doing their job?

    The coaches need to demand US Youth step in. The problem of all the neighboring associations save for Rowlett not being willing to play with Garland must be addressed immediately as the older age divisions are imploding and disappearing. David Arciniega's gross mismanagement has destroyed Garland Soccer. The coaches may need as voting members to dissolve the non-profit corporation as Texas law allows so that Garland Soccer can be completely reorganized under competent leadership.

    When Arciniega became president there were 4000 players. The number now is barely over 2000. With the mass exodus continuing and North Texas now open territory, the number will continue to drop.

    Sleazebag Garland Soccer president, David Arciniega, is also on the North Texas State Soccer Board. He is so dishonest that he has left up the old Player Release Form in what I suspect is a desperate attempt to keep players in Garland. North Texas passed a rule change in July that eliminates those releases allowing players to register and play wherever they wish. There is now one online page that is filled out for players wishing to play outside their home association and it is free!

    Garland Parks and Recreation has a new Managing Director! Hopefully, he will come in and investigate the soccer program and see that our kids are safe and that money is properly accounted for. It is time to serve the kids and taxpayers and end Arciniega's dictatorship!

    I am not surprised at all that Warren Bird was sent packing! Obviously, his departure was sudden judging from his automatic e-mail reply stating he would be back in the office on November 30th. His replacement will be there instead!

    The question is did David Arciniega and Don Starkey and their total mismanagement of Garland Soccer have anything to do with his departure?

    Please read from the bottom up. Note that the city manager claimed that there had been some investigation, when in fact none of the longtime coaches or trustworthy directors I asked them to contact heard from the city. I offered Warren Bird documentation and he didn't bother to request anything. Bird actually resides 3 minutes away from Arciniega in Sachse.

    Hopefully, now the city of Garland and its Parks and Recreation Department will thoroughly investigate the charity, Garland Soccer, that they have sponsored and then clean house. The kids and taxpayers in Garland should know that their safety is a top priority and that their money is being handled properly as well. It is time Garland Soccer change leadership and be forced to be transparent as a charity should be or ship out of Garland so a trustworthy, reputable organization can come in and run a real soccer program for our kids!

    The safety of the children participating in Garland Soccer should be examined. How the money belonging to these families is being handled by this charity should also be questioned. The City of Garland should not sign a field use agreement with this organization until it is thoroughly investigated by The City of Garland, the North Texas State Soccer Association and US Youth Soccer.
    The following issues in Garland Soccer need to be investigated:

    1. Garland’s children were harmed by sexual predator Bernardo Mondragon-Guzman. Garland Soccer made numerous promises in the media. “We’re going to do everything we can to protect our children. And if we need to change things, we’ll do, we’ll change things,” David Arciniega blocked every attempt I made to institute proper policies and procedures to keep Garland’s children safe. Garland Soccer has done nothing in response to children being raped.
    2. A director married to a registered for life, level 2 sex offender with a child victim was letting him handle rosters and other records. This director did not drive and this offender accompanied her everywhere. The president insisted on keeping her on the board knowing the sex offender would be around at every soccer activity possibly putting our children in danger. This clearly violated Garland’s Loitering ordinance.
    3. This same director and her husband were bragging that they would be meeting the association president, David Arciniega, to discuss construction work for GSA when no open bidding was in progress.
    4. $8,000.00 of “missing funds” has no proper documentation as the board is routinely denied documentation by David Arciniega.
    5. Garland Soccer Association president, David Arciniega, lied to the GSA member coaches about those “missing funds” claiming there was ongoing litigation between the software provider, Jevin and the payment processor, Corduro. 2 years later no litigation is on record anywhere.
    6. A former Coach and director were brought up on phony charges when the player pool placed children of the correct age with their coaching parents. Why would children be placed on teams competing against their own parent's teams?
    7. The president, David Arciniega, runs this organization like a dictatorship and flouts the GSA, North Texas State and US Youth Soccer by-laws.
    8. State law concerning fiduciary duties is not being followed.
    9. Elections in Garland Soccer have been rigged for years.
    10. Arciniega filed a No Confidence Petition in an attempt to remove a director who spoke on behalf of a candidate running against him. Members are afraid to vote their conscience.
    11. The number of players and coaches are dropping as folks leave unhappy with their experience in Garland Soccer.
    12. Garland Soccer has lost almost all of its interleague play with neighboring associations. Richardson, Wylie and Chamber Classic have left Garland Soccer. Plano Soccer will not invite us to join them all. The U13 and up depend on interleague to have enough teams to play in their correct age groups.
    13. The coaches are shut down at meetings and their voices are not heard.
    14. The Garland Soccer Association is operated in a shroud of secrecy even though it is in fact a 501 c 3 charity and should be completely transparent.
    15. Members of the association and the public have not been welcomed to the board meetings.
    16. Board meeting agendas, board meeting minutes and board member reports are kept secret.
    17. GSA has no Ethics Committee as North Texas State requires as Arciniega refuses to form one.
    18. GSA has no A & D Committee as required by the by-laws as David Arciniega refuses to allow one to be formed. The A & D process is completely broken and as protocol and procedures are totally flouted all of the hearings are illegal.
    19. David Arciniega and Kim Verity refused to issue A & D decision letters in direct violation of North Texas rules which places Garland Soccer NOT in Good Standing.
    20. A hearing that was called to decide the placement of a child that was placed on his own father's team by the player pool was called by David Arciniega without informing this coach that the placement of his child was being decided.
    21. The Garland Soccer website is not in Spanish though there have been numerous requests over the years for that to happen as much of GSA’s player base is simply not being served.
    22. Garland Soccer puts kids in soccer that are in danger themselves and a danger to others as there is no TOPSoccer program in place for kids that would benefit from it. I was working to form a league for special needs players before Arciniega pushed me out. Now, that has been dropped and these wonderful kids are not being served.


      Garland Soccer is totally corrupt! How did David Arciniega get elected to the NTSSA state board when he totally mismanages Garland Soccer and does not deal honestly? I should not have had to file suit to get the issues in Garland resolved for our kids and coaches.

    Good Standing of Member Association
    To be in good standing in the Association, a Member Association
    must meet all of the following requirements:

    5.Member Associations will provide equitable and prompt hearing and appeal procedures to guarantee the rights of individuals to participate and compete and insure due process to the
    accused. In all hearings conducted, the parties shall be accorded:
    a.Notice of all specific charges or alleged violations in writing and possible
    consequences if the charges are found to be true;

    • b.Reasonable time between receipt of the notice of charges and the hearing within which

    to prepare a defense;

    • c.The right to have the hearing conducted at a time and place so as to make it practicable

    for the person charged to attend;

    • d.A hearing before a disinterested and impartial body of fact finders;
    • e.The right to be assisted in the preparation of one’s case at the hearing;
    • f.The right to call witnesses and present oral and written evidence and argument; Notice

    of all specific charges or alleged violations in writing

    Honor all orders of suspension of persons issued by this Association or one of its Member Associations.

    6.Member Associations will, at all times, recognize the authority, rules, rulings, constitution and
    bylaws of the Association, which comply with the authority of the United States Soccer
    Federation, and its National Associations of which North Texas State Soccer Association is a
    member.


    7.Failure to comply with one or more of the Subsections 1–6 Section 2.1.3, will result in the Executive Committee determining the Member Association is not in good standing. Failure to
    be in good standing is further defined as meaning players and teams registered through the
    Member Association will not be allowed to participate in any tournament/event sponsored or
    sanctioned by NTSSA, nor will they be certified to play outside of the NTSSA in any games,
    tournaments or other competitions for which they might have been otherwise eligible. The
    Member Association may not vote on any matter at any meeting of the Association while it is
    not in good standing.


    8.A Member Association failing to meet any requirements of good standing for a period of sixty

    (60) days shall have its territory declared open and shall not be entitled to vote or to any protection, services or competitions of this Association.

    The defunct Garland Soccer Association board meets tonight. No doubt they haven't set season dates and will just now be talking about starting registration. That is why the players and coaches are leaving in droves. While Frisco, Allen, Richardson, Wylie, Chamber Classic and more will all be in Plano playing together and having a blast, Garland Soccer will still be scrambling to register players and fill teams. Mesquite won't play with Garland either. Lake Highlands was brought in by Director Freeman. Her dad works at Lake Highlands and they left as well save for 2 teams that registered late and couldn't play anywhere else.

    No other associations, save Rowlett with its older girls and Greater Hunt County with 2 U16 Boys teams planned to play in Garland this past fall and may well jump ship this spring. David Arciniega has destroyed Garland's relationship with almost all of the neighboring associations and the school district as well. Garland Soccer is completely imploding....the Arciniega Effect!

    The General Coaches Meeting last week showed an association in collapse. Only about a dozen coaches bothered to show up for the phony election as they know their vote is wasted as past elections have been rigged. They also know the board is powerless and that dictator Arciniega is really running everything behind the scenes. Only 10 of 12 board members showed. President David Arciniega, who inexplicably scheduled the meeting on the same night as his North Texas State Soccer Association board meeting, was a no show. Of course, he must be aware that his dishonesty and mismanagement is driving off more and more soccer coaches and families. He has still, months later, not turned over a single document or cited more than the 1 by-law he submitted for the last lie-filled response filed by the North Texas State Soccer attorney (that has since bailed from my whistleblower lawsuit.)

    Arciniega should be terrified that the coaches are going to confront him and demand to know what really happened to the money, why interleague is disappearing, why Garland Soccer (a charity) is run like a dictatorship under a shroud of secrecy, why the A & D hearings are illegal and why he did not triumph in the lawsuit already in June as promised.

    Reports from the meeting indicate that Paula Tiffin, the office manager, admitted that there were 18 illegal players in the league. That of course is entirely David Arciniega's fault. The rest of the associations under the North Texas State Soccer umbrella use GotSoccer. GotSoccer would catch duplicate registrations of players already on a select team that then later try to register on a recreational team. Since David Arciniega insists on Garland being the only association using Jevin these poor parents that unknowingly sign up their kids on select and recreational teams simultaneously get the kids, coach and whole team punished weeks later when Garland Soccer uploads all the player records in GotSoccer(North Texas uses GotSoccer, so Garland is forced to use it after registration as well.) The rules require that teams using illegal players forfeit every game in which that player is used. That means the whole team loses almost all of their games as the player isn't identified until the season is almost over. This is unexcusable. Several directors and I tried to get Garland Soccer to use GotSoccer like the rest of North Texas to resolve this problem, but David Arciniega who clearly has an inappropriate relationship with Dan Ptak and his Jevin software company won't allow Garland to use the proper registration software. These teams effected by this should file grievances with North Texas and demand that Arciniega be removed for his gross incompetence in failing to address this issue after years of complaints and total dishonesty about where the money paid to Jevin is going.

    At the meeting Paula Tiffin also discussed how there were coaches out there that had not been background checked and should not be coaching. Garland Soccer has been aware of this problem for years and hasn't acted appropriately to resolve that serious issue either. Garland Soccer in essence knowingly allowed people who shouldn't be coaching continue to do so. Garland has no idea who is really out there. I insisted on ID cards in 2013 and as usual Arciniega blocked me. I also wanted practice locations and times kept on record so that more oversight was possible in light of our kids being raped and was shot down. Sex offenders are likely to go elsewhere if there is strict oversight. I also recommended the Positive Coaching Alliance and was shot down as my board reports reflect. That would have provided education for coaches, players and parents to further reduce the risk of sex offenders harming our kids. Arciniega shot that down only to have US Youth Soccer partner with them this year. Arciniega has actively worked to sabotage any effort to keep the kids safer and run the program according to the law and IRS regulations.

    This association has been plagued with A & D problems. The hearings have been illegal for years. Though Arciniega refused to allow an A & D Committee and an Ethics Committee to be formed as the by-laws require, coaches report that the Vice President bragged of having a committee in place. I bet if I call NTSSA to see if the committee members names have been submitted I will find that they have nothing on record. Coaches are calling the VP crooked. She promised to clean up Garland, form the required committees, follow the by-laws and bring David Arciniega up numerous charges that were clearly warranted. She lied to the member coaches to get votes and the coaches are furious that she has not followed through on any of the things she promised.

    The association lost another director and now the U10 director, Jesse Flores, is also in charge of the major league division. The major league is such a disaster with all the associations that refuse to play with Garland that about all he can do with the older age teams is help them take advantage of North Texas being open territory and help them find a neighboring association to register and play in.
