I had actually added a lot of new comments to this but my computer is giving me fits. So my edit did not come through.

Most MLMs stay within the law and regulations that govern them. The illegal ones have to be caught before they can be shut down.
The so called "biz-op rule", as initially proposed by the FTC, would have required a lot more of MLMs. They received more than 17,000 comments, the overwhelming majority of which came from the MLM industry.
The FTC backed off, and the final rule excluded MLMs. (per wserra)
