When Charles loses his appeal and his civil trial, the whole family is going to have to depend on McDonalds charity to eat.

If I were Charlie Scoville, I'd be less worried about the civil actions and more worried about the criminal trial.

Civil actions can only result in fines and disgorgement of ill gotten gains.

I hate to say it, and I really hope I'm wrong, but I have still seen no indication whatsoever that Charles is going to face a criminal trial. There are no law enforcement agencies except the SEC (which cannot bring criminal charges) involved in any stage of this investigation. Every single case you mention above, the FBI or Secret Service or other Federal agency was involved early, taking part in in morning raids for the seizing of records, locking up the offices and shutting the place down on Day One. This has been all SEC and none of the criminal cases started with SEC Civil investigations, even where the civil case was filed before the criminal, the FBI or Secret Service was in at the beginning.

I'm giving better than 50/50 odds he never sees an indictment.

And the Ronald McDonald Charities don't provide free food, they provide lodgings for families with sick children who have to travel out of town to get their children the right medical care. Almost every childrens's Hospital has an attached Ronald McDonald House where families cans stay close to their loved on who is in treatment.

I get what you're saying but I just don't see how one steals that much cash and doesn't get jammed for it.

Ask Charis Johnson, her only punishment was to be mildly inconvenienced, publicly shamed and I think she lost the lease on an apartment. I think she even managed to hide a few dollars under a few rugs, to be honest.

I've had more than a few people tell me that Chris Johnson is "going to be charged in federal and state court soon". A lot has changed since then, the launching of the Financial Fraud Enforcement Task Force, being a major step forward.

It's no coincidence, in my opinion, that every subsequent major ponzi prosecution has involved one or more members of the FFETF.

With the SEC, FBI, Homeland Security, IRS and Secret Service being major players in the task force, the strategy seems to be to use the SEC emergency civil action to halt the / a ponzi scheme and freeze the assets, allowing other members time to collect the evidence necessary to ensure the criminal case which follows is a slam dunk certainty.

IM(very)HO, it's also worth noting while Johnson / 12DP faced only civil securities violation action, which can only result in administrative fines and disgorgement, virtually all criminal charges preferred since then have been for fraud, wire fraud, money laundering and conspiracy, which result in financial penalties AND incarceration.

I'd have to disagree with Gregg.

IM(very)HO, Scoville is looking down the barrel of at least 6 to 7 years in a Federal gaol, on top of what eventuates from the SEC action.
