Unless the UK authorities get off their asses, I don't see where it would matter much.

At best, the receiver would be attempting to come after him as a net winner. Not sure how successful it will be.

Actually Charles is right in the definition of Ponzi. But that doesnt matter really because the law isnt about Ponzis it is about defrauding people of money.
But charles makes a distinction between person A getting money which came from person B who joins the scheme LATER and a person B who is already in the scheme. A Ponzi by charles definition above is when you pay the EARLIER investor A with money from the LATER investor B.
But says Charles a ponzi is NOT when you pay A for clicking on advertisements with money you already got from B for selling them a "service" . In the above case the "service" is the privilege of joining the scheme because they don't seem to get anything else.
So according to Charles if you collect the money from the people lower down the pyramid BEFORE you pay the people at the top then it isnt a Ponzi.
But all people at the top dont actually ever put money in themselves. They just promise to pay people lower down and wait for the recruiting process to generate the money to pay 5% or 10% while they pocket the other 90%.
In any case how could Charles pay people who joined further up the pyramid without using money from lower down unless he put in money from elsewhere [WHICH WAS NOT GENERATED BY THE SCHEME ITSELF]. So he either put in 60 million dollars of his own or of someone else's as an act of charity which he has to prove or the money that is frozen actually came from people in the scheme. Guess what I think? I think he didn't put in his own money and it is actually all from joiners but it is for him to prove his case that it all comes from some other service other than people paying to join.

AS for the personal attacks on the staff of the SEC. Ad hominem may work to some degree in political elections but courts depend on evidence. Charles is really stretching it to claim let alone produce any evidence that the SEC is staffed with corrupt people only about furthering personal status. But even if it was even if Elliot Ness was a nasty man only concerned with furthering his career that would not detract from the fact that Al Capone was a gangster and Ness was pursuing Capone through the legal process.
In fact it turns out ( discovered a generation later) one of Ness's "untouchables" was working for Capone but that does not change Capone's status. The thing is Charles had no evidence to show corruption within the SEC. If he did he might have something to save himself.

So in the end delusional charles thinks his case swings on whether he collected money BEFORE he gave it out or AFTER he promised to give it out when the point is he FRAUDULENTLY collected money and as it happens kept most of it and gave little of it out.

Legally it does not matter if you wait for the positions to fill up on the pyramid before you pay the upper levels. You are still operating a fraud. There isn't any actual business going on! All you are doing is using some persons money to pay other people and keeping some of it (most of it actually) for yourself.

Hate to keep thumping on the expired equine, but the case against TM is not about what its members SAY it is, it is about what it IS! They can try all they want to to claim it is not or was not an investment, but there is plenty of archived evidence out there where it WAS fraudulently promoted as a passive investment prior to their cleanup attempts. Didn't work with ASD, ain't gonna work here!

the guy with the cap and check shirt is Thomas Grant from Australia. He flew out for the court case.
