There's a very good reason Charlie Scoville and his lackey stacy keep on misleading the Traffic Monsoon members with all this talk about investment / not investment and then further distracting attention away from the real charges by talking about the User Agreement and the so called "advertising services"

What are "securities" and why has Scoville been charged with securities related offences, you may ask.

What the numpties don't seem to grasp is that they are arguing two contradictory things at once:-

On one hand, they are saying that TM is "their business" in which they invested time and money.........

....and on the other, they are saying that no, actually, they knew it wasn't an "investment" as all they did was buy advertising. Presumably they have HAD their advertising, so what are they grumbling about?

Can't have it both ways, chaps, so which is it to be?? Er, hello?

It's no coincidence that Scoville, Silly Willy Bryant and stacy keep right away from even mentioning the word "securities"

* What Scoville is selling DOES fall within the definition of securities, just like it did for AdSurf Daily, 12 Daily Pro and CEP.

* Scoville isn't authorized to sell securities, neither has he registered ad packs as securities, therefore he IS "selling unregistered securities"

* But why was Scoville also accused of "fraud" in connection with the sale of the unregistered securities ??



* Because what Scoville told his members and potential members was not true IOW, it was fraud

* But why "intent to defraud" ???

* Because he had done it before and continued to lie even when he was caught in a series of lies.

* The only people who will be asked to return money are those who earned more than they deposited, and probably only then if their winnings exceed $1000

* The judge isn't delaying her decision based on the fifth amendment

* It is EXTREMELY likely Scoville will be sentenced to jail, as well as having to forfeit the proceeds of his crimes AND pay fines AND face penalties

* The whole purpose of appointing a receiver is so that he / she can set about recovering as much as possible so that victims can be compensated.

In the case of Andy Bowdoin / AdSurf Daily, for example, victims who complained and proved their losses received back 100% of their deposits.

BE WARNED: What Nunes is attempting to do happens with the prosecution of every "next-big-thing" HYIP ponzi fraud.

Those at the top do and say anything they can to keep victims on the hook and to prevent them filing complaints or claims for compensation.

The less people who claim compensation, the larger the pot for distribution.

Jose is just worried that if enough of the people he conned into joining TM under him go to the authorities, he will be charged. He's afraid when the US Authorities charge Charles criminally, the UK Authorities will get off their assets and charge all the major UK Pimps of TM too.

It is also why Charles keeps spouting his nonsense about TM not being a Ponzi and operating legally. He knows if enough members file complaints it will harm his defense in this hearing, his civil trial, and his criminal one that will follow.

Charles is still chasing his tail and now dispensing legal opinions courtesy of stacy, of course. Charles sucks at his legal opinions worse than his Ponzi admin skills, which is hard to do. The two of them together would be hard pressed to come up with an IQ of 150.
