    Trey White's Evolv Water vs. World Renowned MD Anderson Cancer Center

    The Motion for Expedited Discovery states:

    Defendant HealtH20 Products, LLC ("HealtH20") contracted with M. D. Anderson to conduct limited in vitro testing of an "enhanced" water beverage comprised of HealtH20's purported Archaea Active formula and City of Houston tap water. (See Declaration of William Hagans attached hereto ("Hagans Decl."), ¶3, Ex. A). Such testing was limited to testing the potential anti-inflammatory properties of the water beverage as provided to M. D. Anderson (inflammation is known to be an issue faced by cancer patients). Id. Indeed, the testing conducted at M. D. Anderson was so limited and preliminary in nature that it rendered inconclusive results—the tests showed that the beverage, as tested by M. D. Anderson, may have some anti-inflammatory properties, but also, that the beverage may act as an inflammatory enhancer. Id. The report generated by M. D. Anderson specifically stated that further testing would need to be conducted. Id.

    Despite the limited and preliminary nature of the testing conducted at M. D. Anderson, Defendants have been claiming that what they, and their cadre of pyramid-based sales people are selling under the brand name Evolv, is, among other things, "backed by research" conducted at M. D. Anderson. (Hagans Decl., ¶4, Ex. B.). These statements are false for at least two unequivocal reasons: (1) Defendants, by their own admission, are not selling the product as tested by M. D. Anderson—M. D. Anderson tested the purported Archaea Active formula as combined with City of Houston tap water, whereas in their Answers to Plaintiff's Complaint, both Defendants claim that the product they are selling is not combined with City of Houston tap water; and (2) any testing conducted by M. D. Anderson was not comprehensive or for that matter, conclusive, as Defendants would have the public believe. (Compare Hagans Decl., ¶3, Ex. A with Defendant Evolv's Answer, Doc. #14, and Defendant HealtH20's Answer and Counterclaims, Doc. #13).

    Plaintiff has gathered substantial evidence of Defendants' unlawful use of Plaintiff's M. D. ANDERSON Marks, including video obtained from such well-known Web sites as YouTube. However, Plaintiff has learned that several of those videos have been removed. (Hagans Decl., ¶5.) Plaintiff believes that Defendants may be responsible for the removal of such videos and that Defendants may be in the process of destroying those videos and other evidence relevant to Plaintiff's trademark infringement and related claims.

    Checking out the ingredients is even more humorous.
    Ingredients - Archaea Active

    The ingredients are alfala, milk whey and ezymes including Amylase, Bromelain, Cellulase, Lactase, Lipase, Papain and Protease enzymes. These ingredients are very cheap and readily available.

    Alfalfa:
    alfalfa - Vitacost

    There are numerous choices for pennies a serving.

    Milk Whey:
    If you want the protein from milk then why not go straight to the source? Also it is found in many supplements here- milk whey - Vitacost

    Enzymes:
    enzymes - Vitacost Vitacost has 401 choices starting a 2 cents per capsule.

    An 8 ounce glass of milk at $3 a gallon is 19 cents a serving. It has 8 grams of protein. The Evolv water is $55-65 dolllars a case plus shipping. That is $2.29 - $2.70 a bottle plus shipping which will be around $15 per case. So add .63 to the figures and the water is $2.92 - $3.33 a bottle. How many people are going to spend that kind of money on fancy water????

    Let's see the exact information on the Evolv label!

    So, just how much is in the "miracle water"? Since it would cost pennies to purchase the ingredients why would I join a pyramid scheme to get readily available ingredients--if I was even going to bother supplementing with that stuff in the first place? Evolv better get some more rigorous testing and double-blind studies underway, because this deal is looking sillier and sillier by the moment!

    That video is explosive. MD Anderson has plenty to say about the dishonest solicitations being made using their name and the sales model where reps gone wild across the net can publish and say things that are misleading and dishonest. Trey White and his flunkies refused to comment.

    EvolvHealth, LLC is a multilevel company headquartered in Dallas, Texas. It's featured product is a bottled water water called Evolv, which it claims will convey many health benefits. The company's Web site claims that "Evolv's beverage combines the Archaea Active formula with natural spring water to combine the health benefits of hydration with
    increased stamina, energy and endurance" [1] and "may" help to maintain circulation; support the immune system; enhance absorption of important nutrients; restore mental alertness; and "neutralize harmful toxins." [2].
    Evolv's benefits are said to result from "unique Archaea Active proprietary technology and backed by studies and testimonials from world-renowned research centers and everyday people like you." The Archaea Active™ formula is said to be made from extracts of alfalfa, milk whey protein, and seven enzymes that undergo manufacturing processes that "remove most all traces of the initial ingredients, leaving behind only picomolar levels of the Archaea Active™ formula." [3] "Picomolar levels" refers to concentrations expressed as trillionths of a gram.


    I can't judge whether the original extracts contain enough nutrients to have any nutritional effect. But even if they did, diluting them to one trillionth of their original concentrations would negate all or most of that effect. Moreover:
    • Alfalfa—concentrated or not—produces no health benefit.
    • If any enzymes survive the manufacturing process, their concentration will be too small to be meaningful.
    • Any whey protein that remains would be trivial compared to the amount of equivalent protein in the average diet.
    • To demonstrate a special health benefit, Evolv would have to be proven in many human clinical trials—and you can safely bet that no such proof exists.
    For all of the above considerations—and more—there's no logical reason to believe that Evolv offers any health benefit beyond that of other bottled waters or of ordinary tap water.
    Dubious Marketing


    From its inception, EvolvHealth's marketing has been centered around statements that the M.D. Anderson Cancer Center has tested its product. In the "OFFICIAL Evolv Introductory Video," for example, Evolv's founder and chairman Trey White, states:
    Evolv is our product. A breakthrough science—a science backed up by documented studies from the country's top-ranked medical research institutions, the University of Texas M.D. Anderson Center in Houston. . .
    It's true that MDACC conducted some tests, but it would be incorrect to conclude that the tests found any health value or that MCACC endorses any of EvolvHealth's claims. EvolvHealth merely hired the MDACC to conduct a few tests related to possible antiinflammatory activity in cell culture preparations. The tests did not determine efficacy or toxicity, and the results are not applicable to humans. In September 2009, MDACC became sufficiently concerned about the company's marketing to issue the following notice:

    We also don't recommend that you don't drink the water, either. Confused? Well there seems to be buzz on the Internet about a type of water that a Dallas-based company is marketing and this water's relationship to M.D. Anderson.
    So we thought we'd un-muddy the water for our patients, employees and supporters. M. D. Anderson doesn't recommend the water.
    What we did do was test the water (this time the pun is not intended) for the company, who compensated us to do so. The tests were very specific, not comprehensive and the results were turned over to the company without interpretation by M.D. Anderson experts.
    Because of the advanced equipment at our institution, we get requests from industry from time to time to use the equipment for commercial endeavors. We evaluate these requests, and if it's not disruptive to patient care and research, we may accommodate for a fee. This is what happened in the case of the water from Dallas.
    M.D. Anderson is focused on patient care, research, education and prevention of cancer. You'd be hard-pressed to get us to stray from that mission, so when you see us appear to recommend something not necessarily related to cancer, please ask questions. In fact, please call us at 877-MDA-6789 and let us know.
    Our lawyers have crafted some nice language fully explaining this situation. Please share it with anybody who might ask you about M.D. Anderson and some newfangled "nutraceutical" water from Dallas.
    M. D. Anderson statement:
    Recently, you may have heard or read about a company that sells Evolv, a "nutraceutical beverage," which is being promoted in part based upon testing done at The University of Texas M.D. Anderson Cancer Center, but also is being mistakenly viewed as endorsed by M.D. Anderson. M.D. Anderson conducted limited chemical analysis of the product to evaluate its anti-inflammatory activity for a fee at the request of the manufacturer. No efficacy or toxicity data were generated at M.D. Anderson nor was the product tested on humans. Moreover, M.D. Anderson does not have any involvement with the company, the product is not produced by M.D. Anderson, and M.D. Anderson does not endorse the product or recommend its use.
    Despite this announcement, EvolvHealth has continued to falsely imply that MDACC found something useful or in some way endorses its product. As of this writing (October 15, 2009), one page on the Archaea Active site acknowledges that MDACC does not endorse or recommend Evolv's product. However, EvolvHealth's promotional videos and printed and Web-based marketing materials have not been modified.
    Income Potential

    EvolvHealth's Official Welcome Video states that the company's cutting edge marketing tools and training will "assure your success and financial freedom." I don't believe that because in addition to being overhyped, it is overpriced. The posted retail price is $55 per case of 24 16.9-ounce bottles, which is $2.29 per bottle. The Wall Street Journal recently reported that the demand for bottled water has been falling and that in the first quarter of 2009, the average price in the United States was $1.35 per gallon [4]. That's about 18 cents per 16,9-ounce bottle. In other words, Evolv is priced at nearly 13 times the cost of the average bottled water product.
    The Bottom Line

    Despite the hype, there's no logical reason to believe that drinking Evolv will provide any special health benefit. The fact that EvolvHealth continues to imply that M.D. Anderson has found Evolv effective is a sign of dishonesty. And its high price compared to other bottled water products will make it difficult for distributors to achieve business success.

    But wait! Something is missing. The lying scammers had posted about 9 multi-million dollar earners and a billion dollar earner and then they removed that fraudulent solicitiation when I e-mailed the Evolv scammers and informed them that all that was in the hands of the Texas Attorney General's Office.

    They also should clarify the million dollar prize is not being given out until this fall and not at this TeamInScamming meeting.

    Obviously, it isn't any problem to get tickets to this MLM scammers' gathering. I wonder if they will discuss the suit MD Anderson has filed against these goons? Using their name to promote a product of dubious value promoted pyramid style seems like grounds for a winning suit to me. We should see a lot more very scathing news coverage related to that!

    I demand the scammers substantiate those multi-million dollar earner claims. Who are these multi-million dollar earners. Folks that want more info about one of the named multi-millionaire earners are welcome to e-mail me and I will provide much more enlightening information!

    Everyone agrees on that: Evolv (which is also known as HealtH20 or EvolvHealth), paid M.D. Anderson to test its some of its water, which, according to the hospital, ain't nothing but Houston tap water with some stuff in it.

    These are the clowns that hosted the shindig this past Saturday that claimed multi-millionaire earners would be there. I sent them documentation to refute some of those claims and they completely ignored me. They are the very reason it is said that MLMs are filled with liars, frauds and con artist.     The Texas Attorney General's office now has all those lofty claims and some scathing documentation to refute them. How long will the scammers continue to wink at this obvious deception? Between the AG's office and the suit Md Anderson was forced to file to get their name off of this pyramid scheme sold zero water, I would say the days for this scum bum deal are definitely numbered. Who in their right mind woud join knowing the world renowned cancer center had to sue to preserve their good name?

    Great leadership from professional business people, LOL!!! None as in exactly zero of the links on that page work. Team InScamming Scammers-in-Chief don't have to work too hard. The top of the pyramid promoters just sit on their laurels while the downline endlessly recruits and they rake it in on the sign-up fees, large kits and intitial orders. Of course, those poor slobs in the downline have to recruit furiously as the newbies drop out like flies when they realize they are paying around 3 dollars a bottle for zero water.

    The links don't work in Explorer for me, but do work fine in Mozilla. Why, I'll be a monkeys uncle!

    We are still left with the real problem though of those thousands they are going to recruit who are at the bottom of this pyramid and can't make any money while the few on top tell them they just need to have more faith and it will happen in God's time. Certainly, there are few if any customers. Who would pay 65 dollars a case plus shipping when a rep gets the water for 55 dollars plus shipping? How long will it take the recruits to figure out that a glass of milk, fresh Alfalfa or a pill and an enzyme tablet would give one exponentially greater amounts of the ingredients in the water for a mere fraction of the price?

    Homeschool math class at my house is always open!

    We have scammers Trey White, Jason Fraser and Brent Hicks in the above photo clearly imbibing something besides the magic water. Mrs. Michelle Fraser says:

    Hold on to you horses there lady. This zero water has virtually nothing in it. A 16 ounce glass of milk has 16 grams of whey protein. The Alfala, which has more protein per ounce than milk and lots of other vitamins and minerals, can be enjoyed fresh on a salad and in a capsule and the enzymes are readily and cheaply available in pill form. I can get exponentially greater amounts of the ingredients in this magic water for a fraction of the cost.

    What is in the water that is provdiding this alleged therapeutic benefit? Why would I pay $55 a case plus shipping to get water that has common, cheap and readily available ingredients? A normal diet contains tons more than zero grams of protein in a day. Where are the major pharmaceutical companies. With the myriad of lofty claims they should be battling it out to get the rights to this secret formula so they can test it and market it. That is where the big bucks are. As MD Anderson is suing them the savvy have figured out just how worthless the stuff likely is.

    I will be anxiously awaiting all the testing on this zero water. Forget the million dollar recruitment prize, Trey, and have the secret formula tested further!

    Arggh. the bastardization of science and medical technology drives me crazy. A one or two time pulse ox reading is meaningless.

    I wonder if she received a gold star for her stellar oxygenation performance. Mr. Frazer is putting out an awful lot of other gases.

    I was puzzled who this Robert Dean (GPD) was that was on the poster.

    Thought GPD was some sort of a medical designation.

    But I was wrong.
