    NTSSA Youth Associations | North Texas Soccer

    I took the liberty of contacting all of the associations under the NTSSA banner. All volunteers (coaches, directors and officers) should be able to trust that NTSSA will take all complaints, concerns, appeals, grievances and questions seriously. There was a rumor that Garland would have teams choosing to go with US Club Soccer. If North Texas doesn't start reaching out to local associations and giving them the support and guidance they need, that will be reality!

    In January 2013 David Arciniega was reporting that the NTSSA board imploded and bragging about how he was doing all the right things in Garland. Really??? The turnover on the board has been tremendous. GSA now has board members that have various communication issues and are not responding to their coaches, some in financial difficulties, one that does not drive and is married to a sex offender who serves as a chauffeur and another that has an alarming internet presence with posts on the internet showing heavy drinking and filled with foul language. Is he sure the GSA board is not imploding???

    Director Crystal Martin joined the board the same time I did at the end of 2012. It was her first season in soccer. Spring 2013 there was a lot of talk in meetings and it was documented on the field director's board report that GSA was going to build a pavilion at Winters Park. There was also continuing talk of a fence at Audubon Park. GSA is a charity and those jobs should be awarded based in a fair bidding process. There should not be any private meetings with a single contractor (especially a current board member.)

    Crystal Martin was running around bragging that David Arciniega was going to meet her husband to talk about the construction jobs. They co-own Luke and Dad Construction: Luke and Dad Construction Crystal and Luke Martin Partners.pdf Can we say conflict of interest, boys and girls? My family asked Luke and Dad Construction to do a very small job at our home. These clowns did not properly cost out the job. We had paid them in full up front and then had to write another check as they claimed they couldn't afford the supplies necessary to finish the job. The F rating with the BBB is certainly justified.

    Martin knew I would not support her getting any construction work with GSA and thus she happily signed that lie-filled No Confidence vote. She continued to whine after that about when David Arciniega was going to meet with her husband about the construction work. When I spoke to other unsatisfied customers of Luke and Dad Construction I learned that he was a Attachment 24503. When I reported all this to GSA president David Arciniega in 2014, he defended these clowns vigorously and knowing all this he has fought tooth and nail to keep this dishonest woman on the board. She doesn't drive, her sex offender husband had access to rosters at public meetings and possibly all records through her director's account. Their construction company could have potentially caused harm to GSA financially if they had been hired to do the work as Martin was counting on.

    There is terrible corruption in GSA. Theoretically the coaches have the power to fix it by voting. In reality leaders using proxies decide the outcome of elections. Referees should not be given proxies by someone who is not a coach and told they must vote for a certain candidate. This should have been stopped before I had to take it to court. Every coach needs to come to the general meetings and vote. Crystal Martin and David Arciniega should have been shown the door long ago.

    In light of the recent news regarding the arrest of a volunteer coach within the Garland Soccer Association, we would like to provide you with our response to this event. The GSA board was extremely shocked and saddened about these allegations. Our hearts go out to this young player and his family. We want to let each of you know that your GSA board is not taking this situation lightly and we will cooperate with the ongoing criminal investigation.

    As most of you know, each of our volunteers endure background checks that entail very stringent criteria. We perform these checks so that we can ensure the safety of our children while participating in GSA related activities. This background check is in addition to the background check required by the North Texas State Soccer Association. We want to assure you that GSA has and will continue to take every measure necessary to protect our children. We would also like to stress the importance of all parents knowing where their children are at all times.

    Lastly, we would like to ask that you refrain from contacting the office to discuss this matter. This is a very difficult time and no one with the GSA office or GSA board is at liberty to discuss or divulge any information relating to the case. Because this investigation entails such a sensitive matter, we would also like to ask that you please refrain from talking to any form of media should someone try and contact you.

    I already published my notes on the numerous rule and by-law violations occurring going into the hearing on the phony charges David Arciniega and Kim Verity filed against me for a child being placed on his (head coach) father's team. I was never sent a decision letter after the attempted lynching. David Arciniega and Kim Verity were trying to prevent me from filing an appeal. I contacted NTSSA yet again and they said I needed a decision letter in order to appeal. So, as I never got one I filed a grievance. I am still waiting for Verity to send that required decision letter and for NTSSA to enforce the rules and take action against Arciniega.

    I am not the only one from GSA who has come with questions, concerns, appeals and grievances and has not been helped. NTSSA needs to step in and take jurisdiction over GSA and fulfill their promise of prompt and equitable resolution of grievances. Volunteers should get the support, training and help they need.

    North Texas State Soccer paid its Executive Director $133,000.00 in 2012. The problem is he works for the board and answers to the board president, so he has no real authority to do anything. The board is all volunteers that have paying full-time jobs, so the promised "prompt and equitable resolution of grievances" is not happening. NTSSA needs to hire adequate staff and give them the authority to step in and handle problems. When local associations have directors asking why there is no proper documentation on "missing payments", local association presidents lying to the members at public meetings, elections being rigged, and local association directors being harassed and intimidated with false charges and phony No Confidence votes, then it is past time for North Texas to take jurisdiction and clean house!

    Dear Fellow Board Members,
    Please find attached the Executive Committee Minutes from the June 30th GSA meeting. That document makes it quite clear that “slow payments” from Jevin are now “missing payments.” At the regular monthly GSA board meeting on July 8th it became glaringly obvious that the explanation for that is wholly unsubstantiated and the board had nothing but David Arciniega’s recounting of what Dan Ptak allegedly claimed on which to base any decisions. David Arciniega stated that Jevin was said to have missing payments in the amount of not just the $8,000.00 plus owed to GSA, but a whopping $50,000.00 including other organizations using Jevin software.

    The board was informed that all this must be kept secret as Dan Ptak of Jevin was filing suit against Corduro (the payment processor) to collect those funds. $50,000.00 alleged to have been stolen by the payment processor is a possible felony. That high dollar amount theft when a non-profit is involved could be a second degree felony. We have an ethical obligation to report this to all the proper authorities. I made a report to the Garland police on the morning of Monday July 8th. The detective handling the case has been informed that the new figure for the “missing payments” was $50,000.00. He needs more documentation and expects that our president will be turning that in and meeting with him to discuss this case. I have the case number for this case that is listed as a theft ($1,500.00 - $20,000.00) and contact information for the detective and want to get that meeting set-up ASAP. If Dan Ptak of Jevin is running a legitimate business then he should have no problem cooperating with law enforcement.

    We as a board must demand that Dan Ptak of Jevin provide all the documentation that substantiates the payment processor Corduro is in fact responsible for the “missing payments.” That documentation would include, but not be limited to all financial records, correspondence, reports filed with the authorities and the lawsuit related to this matter. I believe a registered letter from the board giving him 10 days to turn over the requested documents would be appropriate. We as a board should reconsider our vote and not have David Arciniega sign a contract with Dan Ptak / Jevin until this matter is properly documented and completely resolved. GSA should not be looking the other way when there is possible criminal activity going on, nor should we risk any further loss of GSA funds if in fact it turns out Corduro is not the culprit.
    Corduro is a huge Google backed start –up with over 6 million transactions on Visa annually alone and on the list of 19 Master Card Approved mobile payment processors. Corduro is reported to be handling 1.4 billion a year in transactions. If Corduro is involved in theft it is vital we alert the authorities to protect other non-profits, businesses and individuals who are using them. If the “missing payments” are not due to Corduro then we need to mitigate our losses and change software providers immediately. GSA should not be risking further monetary losses with Jevin. Why are we going forward with Jevin when we don’t have concrete, verifiable documentation on all this?

    I have been an administrator on an anti-scam forum that exposes financial fraud for several years. I have worked with numerous enforcement agencies including the Texas Attorney General’s office, the Texas Department of Insurance, the Texas State Securities Board, various police departments, the FBI and others. I have been sued twice for my blogging about financial fraud and won in district court. I am adamant about getting to the bottom of these “missing payments.” I consulted with several experts that I have worked with over the years about this matter.

    We should for the good of GSA and for our own protection seek out legal counsel to advise us in situations such as this. I have two lawyers among my coaches and have worked with several fine attorneys in the Dallas area. I would be happy to search for a volunteer to help us out.

    This board needs to act on this possibly felonious activity immediately. We have a fiduciary responsibility so, I suggest we treat this as the serious matter it is. This could generate tremendously negative publicity for GSA. A special board meeting needs to be scheduled immediately and a demand letter sent out to Jevin / Dan Ptak as soon as possible.

In addition, it may not be an action organization, i.e., it may not attempt to influence legislation as a substantial part of its activities and it may not participate in any campaign activity for or against political candidates.

    Directors of Minnesota nonprofit corporations must discharge their duties in good faith, in a manner the director reasonably believes to be in the best interests of the corporation, and with the care an ordinarily prudent person in a like position would exercise under similar circumstances…..

    To Exercise the Proper Duty of Care:

    1. Active Participation. A director must actively participate in the management of the organization including attending meetings of the board, evaluating reports, reading minutes, reviewing the performance and compensation of the Executive Director and so on. Persons who do not have the time to participate as required should not agree to be on the board.
    2. Committees. Directors may establish committees having the authority of the board and may rely on information, opinions or reports of these committees. Committees operate subject to the direction and control of the board. As a result, directors are still responsible for the committees and should periodically scrutinize their work.
    3. Board Actions. A director who is present at a meeting when an action is approved by the entire board is presumed to have agreed to the action unless the director objects to the meeting because it was not lawfully called or convened and doesn’t participate in the meeting, or unless the director votes against the action or the director is prohibited from voting on the action because of a conflict of interest.
    4. Minutes of Meetings. Written minutes should be taken at every board meeting. The minutes should accurately reflect board discussions as well as actions taken at meetings.
    5. Books and Records. A director should have general knowledge of the books and records of the organization as well as its general operation. The organization’s articles, bylaws, accounting records, voting agreements and minutes must be made available to members and directors who wish to inspect them for a proper purpose.
    6. Accurate Record Keeping. A director should not only be familiar with the content of the books and records, but should also assure that the organization’s records and accounts are accurate. This may mean the director must take steps to require regular audits by an independent certified public accountant. At the very least, the director should be aware of what the financial records disclose and take appropriate action to make sure there are proper internal controls.
    7. Trust Property. A director has the duty to protect, preserve, invest and manage the corporation’s property and to do so consistent with donor restrictions and legal requirements. Instituting proper internal controls will aid in the protection of assets.
    8. Resources. A director must assist the organization in obtaining adequate resources to enable it to further its charitable mission.
    9. Charitable Trusts. A trustee of a charitable trust has a higher standard of care than a director of a nonprofit corporation. A trustee has the duty to exercise the care an ordinary person would employ in dealing with that person’s own property. A trustee with a greater level of skill must use that higher skill in carrying out the trustee’s duties.
    10. Investigations. A director has a duty to investigate warnings or reports of officer or employee theft or mismanagement. In some situations a director may have to report misconduct to the appropriate authorities, such as the police or the Attorney General. Where appropriate, a director should consult an attorney or other professional for assistance.
    Traditionally, directors have an absolute duty of complete, undivided loyalty to the organization. This means that directors should avoid using their position or the organization’s assets in a way which would result in pecuniary or monetary gain for them or for any member of their family. A director should put the good of the organization first and avoid engaging in transactions with the organization from which the director will benefit…… 4. Outside Help. Where appropriate, directors should obtain opinions of legal counsel or accountants.

I want it on the record that I am opposed to doing business with Jevin at the present time as the board has not been presented with verifiable documentation about the $8,000.00 + that is said to be missing because of the payment processor, Corduro. I believe the board should have access to the correspondence, financial records, and court records etc. related to this so that we can make an informed decision.

    3. I am concerned that GSA as a non-profit did not file charges immediately when the $8,000.00 + dollars was deemed “missing payments.” Our first obligation is loyalty to our organization, GSA. My personal obligations are first loyalty to GSA, second to protect myself by exercising due diligence and acting in “good faith” and lastly in a case like this seeing other organizations and individuals are not harmed by financial fraud.


    If Corduro was the reason for missing payments, why did Dan Ptak not file criminal charges immediately? If he is out $50,000.00 as we have been told, then this seems very odd. If he can’t pay GSA the $8,000.00 that he owes us and apparently can’t qualify for a loan, then how is he going to afford a lawsuit that we are told he is going to file against Corduro? Any reputable attorney may want something like $5,000.00 in retainer minimum. A very small suit can run several hundred thousand dollars in legal fees easily. Why this talk of a suit when we have yet to see police reports, complaints to the DA (http://www.tarrantda.com/wp-content/...plaintForm.pdf) or filings with the Attorney General’s Office (https://www.oag.state.tx.us/forms/cpd/form.php)?

    The experts I consulted about this privately said law enforcement at all those levels should be involved and that the board would benefit from having an attorney to consult for issues like this. Are we going to seek out some legal help?

    With Jevin handling such large amounts of money should they have been bonded and insured?

    Other sports management software providers I have looked at do not handle the money at any time. These providers send an invoice as outlined in their policies. I would much rather have money come directly to us from say Chase or PayPal.......

    From the complaints I am getting it is quite apparent that the U6 Director is not doing her job. She has 68 teams of something less than 220 teams in GSA total. That gives her responsibility for 32% of the coaches and teams. Folks in U4 - U6 that have a bad experience are likely to quit and never return.

    This is a PR disaster and will hurt GSA's numbers and reputation for years to come. So, Don Starkey's and David Arciniega's plan to reduce the number of positions to get rid of me and another director who asks too many questions has backfired royally! The coaches made it clear at the meeting they were against it and it is obvious why! Time to end the use of proxies so Arciniega can't continue to rig the elections!

    Every board member has to under the law fulfill their fiduciary responsibility. That means asking questions and demanding the documentation necessary to make an informed decision. That means sharing pertinent information with the board. I have the right and responsibility to have access to everything and to get actively involved in everything related to running this business / charity.     Spot on from a man that offered to coach a U11 girls' team that had been desperately looking for help for several seasons. He wanted his daughter who was the correct age placed on his team and not an opposing team.

    Please advise of the following:

    1. The minutes have plenty of the information "blacked out". The only information that should be hidden is information that was discussed during a executive session. Are you stating the information blacked out was discussed during an executive session? As a reminder, all meetings (excluding executive sessions) are open records and should be made.
    2. During the 3/4 meeting that I attended, you asked that I and other coaches who were present to leave the room due to an executive session that we could not be part of. After the people who attend left, you stated to me that it was still in an executive session. After an hour I knocked on the door and Don Starkey and you stated you were still in session. However, when you allowed us back in at the end of the meeting, your meeting minutes included information that was discussed and put into motion during the time you stated you were in executive session. Per non-profits rules by the State of Texas, no motions concerning operating activities can be made during executive sessions or behind closed door. This is a direct violation of the GSA and North Texas Bylaws as well as the Non-Profit state rules.
    3. All meetings and board meetings are open to all members, including coaches. You or any board members can not ask any other board members not to communicate to the coaches of these meetings. Furthermore, there should not be any retaliation or harassment to any member, including other board member, due to this.
    4. Your and some of the board members demeanor during the 3/4 Board meeting made the coaches who were present very uncomfortable. In fact, one of your directors walked in at 7 and walked back out and returned at 7:40 due to us being there.

    As I waited outside by the doors, your board members could be heard from the outside yelling, screaming at each other, and pounding on the tables. Some of my players were scared and parents were asking if this is how the board conducted themselves. Some stated if our issue made you all scream this way.


    Bob/Janet, if you need examples or verification of some of these concerns, I will be willing to provide them to you as well as some of the coaches who attended the meeting. I'm sure some board members who were present would be willing to confirm some of these statements as long as they do not fear retaliation by the President or other members of the board.

    Many other reputable associations publish their meeting minutes. We are a charity / youth sports organization. Except for background check appeals and contract details, what is the big secret????

    That Executive Sessions included David Arciniega having all the directors "air their feelings." There was one vicious attack after another. Angela Bowen-Hearn ripped into me. She was in a snit because at the U6 age group coaches' meeting I had hosted I asked all the teams to fill their rosters with at least 3 volunteers that would be background checked. I wanted every team to have a head coach, assistant coach and manager. That is one more way to keep our kids safer and coaches with adequate help are more likely to be retained. GSA is a hostile environment due to the leadership creating said environment.

    Another director e-mailed North Texas State Soccer Association after that disastrous meeting filled with personal attacks and a director angrily walking out because coaches and kids had come to the meeting. That person asked for an NTSSA representative to come to the next meeting due to the hostile environment. NTSSA didn't respond and did not help. David Arciniega has been given a free pass to do whatever he wants unchallenged by NTSSA's authority. Intimidation, retaliation and phony charges are allowed to go on.

    Family sues after sex offender responds to DirecTV service call

    The subcontractor in that story linked above brought along his friend, Mr. Sex Offender, to a customer's home on a job. The subcontractor was promptly fired. Garland Soccer Director, Crystal Martin, brings in her husband a registered sex offender (her chauffeur) to every soccer activity and he handles rosters and corporate documents. The responsible directors told Arciniega that she should be asked to resign. Many veteran coaches wanted her immediately removed as well. She was running around bragging that David Arciniega was going to meet her husband to talk about construction work for Garland Soccer which is a huge conflict of interest and highly unethical on both their parts. What happened to an open bidding process and carefully screening contractors? David Arciniega, the president of Garland Soccer, fights tenaciously to keep her in office.



    This is a sting very similar to the one that caught Director Martin's husband and chauffeur. Who wants a pervert anywhere near our Garland children???

    Martin of course called himself a general contractor. Luke and Dad Construction shows in the Dallas County records as a partnership of Stephen Luke Martin and his Garland Soccer Director wife Crystal Diona Martin. A General Contractor is one of the few people who do construction work that do not have to be licensed in Texas. Other contractors have to be licensed and can't get a license with serious criminal offenses or being registered as a sex offender. I would have never let Martin near my home had I known.

    Matthew Francis and Victoria G. Martin, the mom and dad in Luke and Dad Construction have a $16,268.01federal tax lien that was filed on May 31, 2013 in Dallas County. This lien is listed as one from a "small business / self-employed area # 7." This originates from 1040 taxes for the periods ending 12/31/2003, 12/31/2004, 12/31/2005, 12/31/2006. So, Luke and Dad construction has been a disaster for years.

    And, there is more. The tax evading scumbags at Luke and Dad Construction have 10 more years of taxes due in another tax lien filed on December 5, 2002 in Dallas County. They didn't pay taxes for the periods ending 12/31/1992 and every year after through 12/31/2001. Their residence on that lien shows as a dang P.O. box. They owe $57,535.31 on that one. I assume that includes penalties, so Luke and Dad Construction has never been much of a going concern. Pathetic!

    I used them and know exactly why the F with the BBB.

    Crystal Martin doesn't drive and she and her husband are paupers. Their house almost went into foreclosure in 2013 and now it is in default and a substitute trustee has been named so that it can be foreclosed and auctioned off. She could never print anything for her coaches. She did little work leaving me to create and print our age group handout, give out most of the trophies, give out medals and work the Tournament. Why would he personally chauffeur her everywhere and hang out with kids in a hotel, the libraries, the field house and on the pitch when they desperately needed money to hang on to their house? Did her sex offender husband want her in Garland Soccer in a position of authority for a nefarious purpose???

    Arciniega keeping Crystal Martin in as a director is one of many reasons I filed suit!

    Did president David Arciniega and his rubber stamper former Vice President, Kim Verity, ever consider how their actions would effect their own reputations? Did it occur to them that their antics would negatively effect the reputations of others? The current board is filled with professional people who do not want to be associated with possible financial fraud and dereliction of fiduciary duties. And who wants to be known as a director in an association that does not listen to their coaches and one in which coaches and their kids are placed on opposing teams.

    The rumor mill, thanks to David Arciniega's phony charges for a child being placed on his father's team and the lie-filled No Confidence vote he undoubtedly also made Kim Verity craft and all the other manipulations, has ruined my reputation. If my son was ever well enough for me to reenter the workforce I would be terribly handicapped by this egregious mess of a charity on my resume.

    It is high time that North Texas State and US Youth Soccer step in and get this organization back on track with open meetings and complete transparency. No volunteer should ever be put through hell volunteers in GSA have.
