The point seems to be repeated again and again that TM Affiliates were not investors based on screenshots of people saying they accept it is not an investment and is all at their own risk.
Two points on this.
1. As TM had a solicitor/commissioner for oaths at that very beach to verify the identity of the signatories Sunil should be aware of the admissability and verification process. how is the court to know this is his actual account?
2. If you go into a bar and the bar has a sign up saying "you drink here at your own risk" and you fall into a table of glasses and cut yourself the sign saying they take no responsibility isn't proof of anything! similar for parking or leaving your handbag "at your own risk" the sentiments on the sign may not be enforceable and any disclaimer may not be legally valid. so saying "click here to accept this is not an investment" isn't proof that you were not offering it as an investment.

Going bankrupt is not something to be undertaken lightly. It affects your credit rating.
